88 relating to the creation of a statewide Chronic Wasting Disease
99 plan.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 11, Parks and Wildlife Code, is amended
1212 by adding Subchapter Q to read as follows:
1313 SUBCHAPTER Q. CHRONIC WASTING DISEASE IN DEER.
1414 Sec. 11.501. ASSESSMENT BY THE TEXAS A&M COLLEGE OF
1515 VETERINARY MEDICINE AND BIOMEDICAL SCIENCES. (a) The Texas A&M
1616 College of Veterinary Medicine and Biomedical Sciences shall
1717 evaluate the Texas Department of Parks and Wildlife's overall
1818 Chronic Wasting Disease management since 2015 in general and the
1919 department's implementation of the Texas Department of Parks and
2020 Wildlife's August 2020 Chronic Wasting Disease Management Plan.
2121 (b) The Texas A&M College of Veterinary Medicine and
2222 Biomedical Sciences shall compare the Texas Department of Parks and
2323 Wildlife's overall Chronic Wasting Disease management since 2015 in
2424 general and the department's implementation of the Texas Department
2525 of Parks and Wildlife's August 2020 Chronic Wasting Disease
2626 Management Plan to:
2727 (1) Other states' plans and policies related to Chronic
2828 Wasting Disease in deer;
2929 (2) Any national standards related to Chronic Wasting
3030 Disease in deer; and
3131 (3) Any generally accepted practices related to Chronic
3232 Wasting Disease in deer.
3333 (c) The Texas A&M College of Veterinary Medicine and
3434 Biomedical Sciences shall create a Statewide Chronic Wasting
3535 Disease Plan that describes plans and policies used by other
3636 states, national standards, and any other generally accepted
3737 practices related to Chronic Wasting Disease in deer.
3838 (d) The executive director of the Texas Department of Parks
3939 and Wildlife shall implement the practices described by the Texas
4040 A&M College of Veterinary Medicine and Biomedical Sciences'
4141 Statewide plan related to Chronic Wasting Disease in the state's
4242 deer population.
4343 (e) The Texas A&M College of Veterinary Medicine and
4444 Biomedical Sciences shall monitor the Texas Department of Parks and
4545 Wildlife's implementation of the Statewide Chronic Wasting Disease
4646 Plan. The Texas A&M College of Veterinary Medicine and Biomedical
4747 Sciences shall create a report detailing the Texas Department of
4848 Parks and Wildlife's implementation of the Statewide Chronic
4949 Wasting Disease Plan. The Texas A&M College of Veterinary
5050 Medicine and Biomedical Sciences shall send the report to each
5151 member of the legislature, the lieutenant governor, and the Texas
5252 Sunset Commission before the beginning of each legislative session.
5353 SECTION 2. Chapter 161, Agriculture Code, is amended by
5454 adding Subchapter I to read as follows:
5555 SUBCHAPTER I. CHRONIC WASTING DISEASE IN DEER.
5656 Sec. 161.160. ASSESSMENT BY THE TEXAS A&M COLLEGE OF
5757 VETERINARY MEDICINE AND BIOMEDICAL SCIENCES. (a) The Texas A&M
5858 College of Veterinary Medicine and Biomedical Sciences shall
5959 evaluate the Texas Animal Health Commission's overall Chronic
6060 Wasting Disease management since 2015 in general and the
6161 department's implementation of the Texas Department of Parks and
6262 Wildlife's August 2020 Chronic Wasting Disease Management Plan.
6363 (b) The Texas A&M College of Veterinary Medicine and
6464 Biomedical Sciences shall compare the Texas Animal Health
6565 Commission's overall Chronic Wasting Disease management since 2015
6666 in general and the Texas Animal Commission's implementation of the
6767 Texas Department of Parks and Wildlife's August 2020 Chronic
6868 Wasting Disease Management Plan to:
6969 (1) Other states' plans and policies related to
7070 Chronic Wasting Disease in deer;
7171 (2) Any national standards related to Chronic Wasting
7272 Disease in deer; and
7373 (3) Any generally accepted practices related to
7474 Chronic
7575 Wasting Disease in deer.
7676 (c) The Texas A&M College of Veterinary Medicine and
7777 Biomedical Sciences shall create a Statewide Chronic Wasting
7878 Disease Plan that describes plans and policies used by other
7979 states, national standards, and any other generally accepted
8080 practices related to Chronic Wasting Disease in deer.
8181 (d) The executive director of the Texas Animal Health
8282 Commission shall implement the practices described by the Texas A&M
8383 College of Veterinary Medicine and Biomedical Sciences' Statewide
8484 related to Chronic Wasting Disease in the state's deer population.
8585 (e) The Texas A&M College of Veterinary Medicine and
8686 Biomedical Sciences shall monitor the Texas Animal Health
8787 Commission's implementation of the Statewide Chronic Wasting
8888 Disease Plan. The Texas A&M College of Veterinary Medicine and
8989 Biomedical Sciences shall create a report detailing the Texas
9090 Animal Health Commission's implementation of the Statewide Chronic
9191 Wasting Disease Plan. The Texas A&M College of Veterinary Medicine
9292 and Biomedical Sciences shall send the report to each member of the
9393 legislature, the lieutenant governor, and the Texas Sunset
9494 Commission before the beginning of each legislative session.
9595 SECTION 3. This Act takes effect immediately if it receives
9696 a vote of two-thirds of all the members elected to each house, as
9797 provided by Section 39, Article III, Texas Constitution. If this
9898 Act does not receive the vote necessary for immediate effect, this
9999 Act takes effect September 1, 2025.
