77 AN ACT
88 relating to the prohibition on water fluoridation; creating a
99 penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle A, Title 5, Chapter 341, Subchapter A,
1212 Texas Health and Safety Code, is amended by adding new Section
1313 341.033 (j) to read as follows:
1414 Sec. 341.033 (j) FLUORIDE INTRODUCTION PROHIBITED.
1515 (a) For the purposes of this section:
1616 (1) "Commission" means the Texas Commission on
1717 Environmental Quality.
1818 (2) "Fluoride" means any chemical compound containing
1919 the fluoride ion, including sodium fluoride, hydrofluoric acid,
2020 sodium silicofluoride, and fluorosilicic acid;
2121 (3) "Public water supply" means a water system that
2222 provides water for human consumption through pipes or other
2323 constructed conveyances to at least fifteen service connections or
2424 serves an average of at least twenty-five people for at least sixty
2525 days a year.
2626 (b) A person may not add or cause to be added any form of
2727 fluoride to any public water supply for the purpose of
2828 fluoridation, regardless of the intended concentration.
2929 (c) This section does not apply to any water treatment
3030 process where fluoride is naturally occurring in a water source or
3131 the use of fluoride for an industrial or manufacturing process not
3232 related to public water treatment.
3333 (d) A person in violation of this section is subject to a
3434 fine of five hundred dollars, and subject to a fine of one thousand
3535 dollars for a subsequent violation.
3636 (e) The Commission shall enforce this section.
3737 SECTION 2. This Act takes effect September 1, 2025.
