| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subtitle A, Title 5, Chapter 341, Subchapter A, |
|---|
| 12 | 12 | | Texas Health and Safety Code, is amended by adding new Section |
|---|
| 13 | 13 | | 341.033 (j) to read as follows: |
|---|
| 14 | 14 | | Sec. 341.033 (j) FLUORIDE INTRODUCTION PROHIBITED. |
|---|
| 15 | 15 | | (a) For the purposes of this section: |
|---|
| 16 | 16 | | (1) "Commission" means the Texas Commission on |
|---|
| 17 | 17 | | Environmental Quality. |
|---|
| 18 | 18 | | (2) "Fluoride" means any chemical compound containing |
|---|
| 19 | 19 | | the fluoride ion, including sodium fluoride, hydrofluoric acid, |
|---|
| 20 | 20 | | sodium silicofluoride, and fluorosilicic acid; |
|---|
| 21 | 21 | | (3) "Public water supply" means a water system that |
|---|
| 22 | 22 | | provides water for human consumption through pipes or other |
|---|
| 23 | 23 | | constructed conveyances to at least fifteen service connections or |
|---|
| 24 | 24 | | serves an average of at least twenty-five people for at least sixty |
|---|
| 25 | 25 | | days a year. |
|---|
| 26 | 26 | | (b) A person may not add or cause to be added any form of |
|---|
| 27 | 27 | | fluoride to any public water supply for the purpose of |
|---|
| 28 | 28 | | fluoridation, regardless of the intended concentration. |
|---|
| 29 | 29 | | (c) This section does not apply to any water treatment |
|---|
| 30 | 30 | | process where fluoride is naturally occurring in a water source or |
|---|
| 31 | 31 | | the use of fluoride for an industrial or manufacturing process not |
|---|
| 32 | 32 | | related to public water treatment. |
|---|
| 33 | 33 | | (d) A person in violation of this section is subject to a |
|---|
| 34 | 34 | | fine of five hundred dollars, and subject to a fine of one thousand |
|---|
| 35 | 35 | | dollars for a subsequent violation. |
|---|
| 36 | 36 | | (e) The Commission shall enforce this section. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2025. |
