611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the procedure for certain complaints against health
914 care practitioners.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Chapter 112, Occupations Code, is amended by
1217 adding Subchapter C to read as follows:
1318 SUBCHAPTER C. COMPLAINT REFERRALS
1419 Sec. 112.101. COMPLAINTS AGAINST HEALTH CARE PRACTITIONER
1520 LICENSED BY DIFFERENT LICENSING ENTITY. (a) Notwithstanding any
1621 other law, a licensing entity that receives a complaint concerning
1722 a health care practitioner who holds a license issued by a different
1823 licensing entity shall promptly forward a copy of the complaint to
1924 that licensing entity.
2025 (b) A licensing entity may not take disciplinary action
2126 based on a complaint against a health care practitioner who holds a
2227 license issued by a different licensing entity unless that
2328 licensing entity refers the complaint back to the licensing entity
2429 that received the complaint for investigation and resolution.
2530 (c) This section does not preclude a licensing entity from
2631 taking disciplinary action against a health care practitioner
2732 licensed by that entity.
2833 SECTION 2. The changes in law made by this Act apply only to
2934 a complaint filed against a health care practitioner on or after the
3035 effective date of this Act. A complaint filed before the effective
3136 date of this Act is governed by the law in effect on the date the
3237 complaint was filed, and the former law is continued in effect for
3338 that purpose.
3439 SECTION 3. This Act takes effect immediately if it receives
3540 a vote of two-thirds of all the members elected to each house, as
3641 provided by Section 39, Article III, Texas Constitution. If this
3742 Act does not receive the vote necessary for immediate effect, this
3843 Act takes effect September 1, 2025.
