10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 16 | | SECTION 1. Chapter 112, Occupations Code, is amended by |
---|
12 | 17 | | adding Subchapter C to read as follows: |
---|
13 | 18 | | SUBCHAPTER C. COMPLAINT REFERRALS |
---|
14 | 19 | | Sec. 112.101. COMPLAINTS AGAINST HEALTH CARE PRACTITIONER |
---|
15 | 20 | | LICENSED BY DIFFERENT LICENSING ENTITY. (a) Notwithstanding any |
---|
16 | 21 | | other law, a licensing entity that receives a complaint concerning |
---|
17 | 22 | | a health care practitioner who holds a license issued by a different |
---|
18 | 23 | | licensing entity shall promptly forward a copy of the complaint to |
---|
19 | 24 | | that licensing entity. |
---|
20 | 25 | | (b) A licensing entity may not take disciplinary action |
---|
21 | 26 | | based on a complaint against a health care practitioner who holds a |
---|
22 | 27 | | license issued by a different licensing entity unless that |
---|
23 | 28 | | licensing entity refers the complaint back to the licensing entity |
---|
24 | 29 | | that received the complaint for investigation and resolution. |
---|
25 | 30 | | (c) This section does not preclude a licensing entity from |
---|
26 | 31 | | taking disciplinary action against a health care practitioner |
---|
27 | 32 | | licensed by that entity. |
---|
28 | 33 | | SECTION 2. The changes in law made by this Act apply only to |
---|
29 | 34 | | a complaint filed against a health care practitioner on or after the |
---|
30 | 35 | | effective date of this Act. A complaint filed before the effective |
---|
31 | 36 | | date of this Act is governed by the law in effect on the date the |
---|
32 | 37 | | complaint was filed, and the former law is continued in effect for |
---|
33 | 38 | | that purpose. |
---|
34 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
---|
35 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 43 | | Act takes effect September 1, 2025. |
---|
