77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting a public institution of higher education
1010 from providing benefits to a student organization that receives
1111 financial support from an entity of concern.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.93151 to read as follows:
1515 Sec. 51.93151. PROHIBITION ON PROVIDING FUNDING AND OTHER
1616 BENEFITS TO CERTAIN STUDENT ORGANIZATIONS. (a) In this section:
1717 (1) "Benefit" and "student organization" have the
1818 meanings assigned by Section 51.9315.
1919 (2) "Entity of concern" means:
2020 (A) the People's Republic of China;
2121 (B) the Republic of Cuba;
2222 (C) the Islamic Republic of Iran;
2323 (D) the Democratic People's Republic of Korea;
2424 (E) the State of Qatar;
2525 (F) the Russian Federation;
2626 (G) the Syrian Arab Republic;
2727 (H) the Venezuelan regime of Nicolás Maduro;
2828 (I) a foreign organization designated as a
2929 foreign terrorist organization by the United States secretary of
3030 state as authorized by 8 U.S.C. Section 1189;
3131 (J) an entity designated by the governor after
3232 consultation with the Homeland Security Council established under
3333 Subchapter B, Chapter 421, Government Code; and
3434 (K) an agent of or other entity under significant
3535 control of a country or entity described by Paragraphs (A) through
3636 (J).
3737 (3) "Institution of higher education" has the meaning
3838 assigned by Section 61.003.
3939 (b) Notwithstanding Section 51.9315, an institution of
4040 higher education may not provide any benefit to a student
4141 organization that receives financial support from an entity of
4242 concern.
4343 SECTION 2. This Act applies beginning with the 2025-2026
4444 academic year.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2025.
