| 11 | 18 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 19 | | SECTION 1. Section 13.043(c), Water Code, is amended to |
|---|
| 13 | 20 | | read as follows: |
|---|
| 14 | 21 | | (c) An appeal under Subsection (b) must be initiated by |
|---|
| 15 | 22 | | filing a petition for review with the utility commission and the |
|---|
| 16 | 23 | | entity providing service within 90 days after the effective day of |
|---|
| 17 | 24 | | the rate change or, if appealing under Subsection [Subdivision] |
|---|
| 18 | 25 | | (b)(2) or (5), within 90 days after the date on which the governing |
|---|
| 19 | 26 | | body of the municipality or affected county makes a final decision. |
|---|
| 20 | 27 | | The petition must be signed by at least: |
|---|
| 21 | 28 | | (1) the lesser of 10,000 or 10 percent of those |
|---|
| 22 | 29 | | ratepayers whose rates have been changed and who are eligible to |
|---|
| 23 | 30 | | appeal under Subsection (b); or |
|---|
| 24 | 31 | | (2) 10 percent of those ratepayers in the same |
|---|
| 25 | 32 | | customer class whose rates have been changed and who are eligible to |
|---|
| 26 | 33 | | appeal under Subsection (b). |
|---|
| 27 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 38 | | Act takes effect September 1, 2025. |
