613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to the filing of an appeal regarding certain water,
916 drainage, or sewer rates with the Public Utility Commission of
1017 Texas.
1118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1219 SECTION 1. Section 13.043(c), Water Code, is amended to
1320 read as follows:
1421 (c) An appeal under Subsection (b) must be initiated by
1522 filing a petition for review with the utility commission and the
1623 entity providing service within 90 days after the effective day of
1724 the rate change or, if appealing under Subsection [Subdivision]
1825 (b)(2) or (5), within 90 days after the date on which the governing
1926 body of the municipality or affected county makes a final decision.
2027 The petition must be signed by at least:
2128 (1) the lesser of 10,000 or 10 percent of those
2229 ratepayers whose rates have been changed and who are eligible to
2330 appeal under Subsection (b); or
2431 (2) 10 percent of those ratepayers in the same
2532 customer class whose rates have been changed and who are eligible to
2633 appeal under Subsection (b).
2734 SECTION 2. This Act takes effect immediately if it receives
2835 a vote of two-thirds of all the members elected to each house, as
2936 provided by Section 39, Article III, Texas Constitution. If this
3037 Act does not receive the vote necessary for immediate effect, this
3138 Act takes effect September 1, 2025.
