7	12		AN ACT
8	13		relating to certain oversize or overweight vehicle permit fees or
9	14		surety requirements.
10	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	16		SECTION 1. Section 622.134(c), Transportation Code, is
12	17		amended to read as follows:
13	18		(c) This section [Subsection (a)] does not apply to a
14	19		vehicle owned by a municipality or a county. The department by rule
15	20		may exempt a vehicle owned by any other governmental entity from the
16	21		application of this section.
17	22		SECTION 2. Subchapter A, Chapter 623, Transportation Code,
18	23		is amended by adding Section 623.009 to read as follows:
19	24		Sec. 623.009. WAIVER OF PERMIT FEE OR SURETY REQUIREMENT
20	25		FOR GOVERNMENTAL ENTITIES. The department by rule may waive the fee
21	26		and any surety requirements, including a requirement for a bond or
22	27		letter of credit, for a permit issued by the department under this
23	28		subtitle to a governmental entity.
24	29		SECTION 3. Section 623.077(a), Transportation Code, is
25	30		amended to read as follows:
26	31		(a) An applicant for a permit under this subchapter, other
27	32		than a permit under Section 623.071(c)(3) or (d), must also pay a
28	33		highway maintenance fee in an amount determined according to the
29	34		following table:

43	48		municipality. The department by rule may exempt a vehicle owned by
44	49		any other governmental entity from the application of this section.
45	50		SECTION 5. This Act takes effect September 1, 2025.
