77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to including vehicles of certain prosecutors in the
1010 definition of authorized emergency vehicle.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 541.201(1), Transportation Code, is
1313 amended to read as follows:
1414 (1) "Authorized emergency vehicle" means:
1515 (A) a fire department or police vehicle;
1616 (B) a public or private ambulance operated by a
1717 person who has been issued a license by the Department of State
1818 Health Services;
1919 (C) an emergency medical services vehicle:
2020 (i) authorized under an emergency medical
2121 services provider license issued by the Department of State Health
2222 Services under Chapter 773, Health and Safety Code; and
2323 (ii) operating under a contract with an
2424 emergency services district that requires the emergency medical
2525 services provider to respond to emergency calls with the vehicle;
2626 (D) a municipal department or public service
2727 corporation emergency vehicle that has been designated or
2828 authorized by the governing body of a municipality;
2929 (E) a county-owned or county-leased emergency
3030 management vehicle that has been designated or authorized by the
3131 commissioners court;
3232 (F) a vehicle that has been designated by the
3333 department under Section 546.0065;
3434 (G) a private vehicle of a volunteer firefighter
3535 or a certified emergency medical services employee or volunteer
3636 when responding to a fire alarm or medical emergency;
3737 (H) an industrial emergency response vehicle,
3838 including an industrial ambulance, when responding to an emergency,
3939 but only if the vehicle is operated in compliance with criteria in
4040 effect September 1, 1989, and established by the predecessor of the
4141 Texas Industrial Emergency Services Board of the State
4242 Firefighters' and Fire Marshals' Association of Texas;
4343 (I) a vehicle of a blood bank or tissue bank,
4444 accredited or approved under the laws of this state or the United
4545 States, when making emergency deliveries of blood, drugs,
4646 medicines, or organs;
4747 (J) a vehicle used for law enforcement purposes
4848 that is owned or leased by a federal governmental entity; [or]
4949 (K) a private vehicle of an employee or volunteer
5050 of a county emergency management division in a county with a
5151 population of more than 52,600 and less than 55,000 that is
5252 designated as an authorized emergency vehicle by the commissioners
5353 court of that county; or
5454 (L) a publicly or privately owned vehicle of:
5555 (i) a district attorney, criminal district
5656 attorney, or county attorney; or
5757 (ii) a prosecutor employed by a district
5858 attorney, criminal district attorney, county attorney, or the
5959 attorney general's office.
6060 SECTION 2. This Act takes effect September 1, 2025.
