9 | 9 | | relating to including vehicles of certain prosecutors in the |

10 | 10 | | definition of authorized emergency vehicle. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 541.201(1), Transportation Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (1) "Authorized emergency vehicle" means: |
---|
15 | 15 | | (A) a fire department or police vehicle; |
---|
16 | 16 | | (B) a public or private ambulance operated by a |
---|
17 | 17 | | person who has been issued a license by the Department of State |
---|
18 | 18 | | Health Services; |
---|
19 | 19 | | (C) an emergency medical services vehicle: |
---|
20 | 20 | | (i) authorized under an emergency medical |
---|
21 | 21 | | services provider license issued by the Department of State Health |
---|
22 | 22 | | Services under Chapter 773, Health and Safety Code; and |
---|
23 | 23 | | (ii) operating under a contract with an |
---|
24 | 24 | | emergency services district that requires the emergency medical |
---|
25 | 25 | | services provider to respond to emergency calls with the vehicle; |
---|
26 | 26 | | (D) a municipal department or public service |
---|
27 | 27 | | corporation emergency vehicle that has been designated or |
---|
28 | 28 | | authorized by the governing body of a municipality; |
---|
29 | 29 | | (E) a county-owned or county-leased emergency |
---|
30 | 30 | | management vehicle that has been designated or authorized by the |
---|
31 | 31 | | commissioners court; |
---|
32 | 32 | | (F) a vehicle that has been designated by the |
---|
33 | 33 | | department under Section 546.0065; |
---|
34 | 34 | | (G) a private vehicle of a volunteer firefighter |
---|
35 | 35 | | or a certified emergency medical services employee or volunteer |
---|
36 | 36 | | when responding to a fire alarm or medical emergency; |
---|
37 | 37 | | (H) an industrial emergency response vehicle, |
---|
38 | 38 | | including an industrial ambulance, when responding to an emergency, |
---|
39 | 39 | | but only if the vehicle is operated in compliance with criteria in |
---|
40 | 40 | | effect September 1, 1989, and established by the predecessor of the |
---|
41 | 41 | | Texas Industrial Emergency Services Board of the State |
---|
42 | 42 | | Firefighters' and Fire Marshals' Association of Texas; |
---|
43 | 43 | | (I) a vehicle of a blood bank or tissue bank, |
---|
44 | 44 | | accredited or approved under the laws of this state or the United |
---|
45 | 45 | | States, when making emergency deliveries of blood, drugs, |
---|
46 | 46 | | medicines, or organs; |
---|
47 | 47 | | (J) a vehicle used for law enforcement purposes |
---|
48 | 48 | | that is owned or leased by a federal governmental entity; [or] |
---|
49 | 49 | | (K) a private vehicle of an employee or volunteer |
---|
50 | 50 | | of a county emergency management division in a county with a |
---|
51 | 51 | | population of more than 52,600 and less than 55,000 that is |
---|
52 | 52 | | designated as an authorized emergency vehicle by the commissioners |
---|
53 | 53 | | court of that county; or |
---|
54 | 54 | | (L) a publicly or privately owned vehicle of: |
---|
55 | 55 | | (i) a district attorney, criminal district |
---|
56 | 56 | | attorney, or county attorney; or |
---|
57 | 57 | | (ii) a prosecutor employed by a district |
---|
58 | 58 | | attorney, criminal district attorney, county attorney, or the |
---|
59 | 59 | | attorney general's office. |
---|
60 | 60 | | SECTION 2. This Act takes effect September 1, 2025. |
