77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the amount of a large risk that is exempt from certain
1010 property and casualty insurance policy form requirements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2301.004, Insurance Code, is amended to
1313 read as follows:
1414 Sec. 2301.004. EXEMPTION FOR LARGE RISKS. Sections
1515 2301.006, 2301.007(a) and (b), and 2301.008 do not apply to forms
1616 for use with an insured that has:
1717 (1) total insured property values of $20 [$5] million
1818 or more;
1919 (2) total annual gross revenues of $100 [$10] million
2020 or more; or
2121 (3) a total premium of $100,000 [$25,000] or more for
2222 property insurance, $100,000 [$25,000] or more for general
2323 liability insurance, or $250,000 [$50,000] or more for multiperil
2424 insurance.
2525 SECTION 2. Section 2301.004, Insurance Code, as amended by
2626 this Act, applies only to an insurance policy delivered, issued for
2727 delivery, or renewed on or after January 1, 2026. A policy
2828 delivered, issued for delivery, or renewed before January 1, 2026,
2929 is governed by the law as it existed immediately before the
3030 effective date of this Act, and that law is continued in effect for
3131 that purpose.
3232 SECTION 3. This Act takes effect September 1, 2025.
