77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to sexual abuse and assault prevention training for
1010 employees of amusement ride operators.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2151.101(a), Occupations Code, is
1313 amended to read as follows:
1414 (a) A person may not operate an amusement ride unless the
1515 person:
1616 (1) has had the amusement ride inspected at least once
1717 a year by an insurer or a person with whom the insurer has
1818 contracted;
1919 (2) obtains a written certificate from the insurer or
2020 person with whom the insurer has contracted stating that the
2121 amusement ride:
2222 (A) has been inspected;
2323 (B) meets the standards for insurance coverage;
2424 and
2525 (C) is covered by the insurance required by
2626 Subdivision (3);
2727 (3) except as provided by Sections 2151.1011 and
2828 2151.1012, has a combined single limit or split limit insurance
2929 policy currently in effect written by an insurance company
3030 authorized to do business in this state or by a surplus lines
3131 insurer, as defined by Chapter 981, Insurance Code, or has an
3232 independently procured policy subject to Chapter 101, Insurance
3333 Code, insuring the owner or operator against liability for injury
3434 to persons arising out of the use of the amusement ride in an amount
3535 of not less than:
3636 (A) for Class A amusement rides:
3737 (i) $100,000 bodily injury and $50,000
3838 property damage per occurrence with a $300,000 annual aggregate; or
3939 (ii) a $150,000 per occurrence combined
4040 single limit with a $300,000 annual aggregate; and
4141 (B) for Class B amusement rides:
4242 (i) $1,000,000 bodily injury and $500,000
4343 property damage per occurrence; or
4444 (ii) $1,500,000 per occurrence combined
4545 single limit;
4646 (4) files with the commissioner, as required by this
4747 chapter, the inspection certificate and the insurance policy or a
4848 photocopy of the certificate or policy authorized by the
4949 commissioner; [and]
5050 (5) files with each sponsor, lessor, landowner, or
5151 other person responsible for the amusement ride being offered for
5252 use by the public a photocopy of the inspection certificate and the
5353 insurance policy required by this subsection; and
5454 (6) requires each employee to complete a training
5555 program on sexual abuse and assault prevention.
5656 SECTION 2. This Act takes effect September 1, 2025.
