77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to electric utility planning and cost recovery for
1010 enhancing service reliability for vulnerable customers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 38.078(d), Utilities Code, as added by
1313 Chapter 836 (H.B. 2555), Acts of the 88th Legislature, Regular
1414 Session, 2023, is amended to read as follows:
1515 (d) In determining whether to approve a plan filed under
1616 this section, the commission shall consider:
1717 (1) the extent to which the plan is expected to enhance
1818 system resiliency, including whether the plan prioritizes areas of
1919 lower performance;
2020 (2) the extent to which the plan is expected to enhance
2121 service reliability for vulnerable customers, including elderly
2222 persons and persons with a disability; and
2323 (3) [(2)] the estimated costs of implementing the
2424 measures proposed in the plan.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2025.
