| 12 | 12 | SECTION 1. Subchapter D, Chapter 533, Health and Safety | |
| 13 | 13 | Code, is amended by adding Section 533.088 to read as follows: | |
| 14 | 14 | Sec. 533.088. LEASE OF REAL PROPERTY ON AUSTIN STATE | |
| 15 | 15 | HOSPITAL CAMPUS. Notwithstanding Section 533.084 or 533.087 or any | |
| 16 | 16 | other law, the department, in coordination with the executive | |
| 17 | 17 | commissioner, may lease real property or an improvement on the | |
| 18 | 18 | Austin State Hospital campus for less than the prevailing market | |
| 19 | 19 | rate, without advertisement or competitive bidding, if: | |
| 20 | 20 | (1) the executive commissioner determines the real | |
| 21 | 21 | property or improvement is not being used by the department; and | |
| 22 | 22 | (2) the real property or improvement: | |
| 23 | 23 | (A) will be used to provide mental health | |
| 24 | 24 | services, including jail diversion services; and | |
| 25 | 25 | (B) is leased to a unit of local government. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2025. |
