77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the consideration of the cumulative effects of air
1010 contaminant emissions in the emissions permitting process.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.0518, Health and Safety Code, is
1313 amended by adding Subsection (b-1) to read as follows:
1414 (b-1) In making its finding under Subsection (b)(2) as to
1515 whether emissions from the facility will contravene the intent of
1616 this chapter, the commission shall consider the cumulative effects
1717 on the public's health and physical property of expected air
1818 contaminant emissions from the facility or proposed facility and
1919 from other facilities located less than three miles from the
2020 facility or proposed facility.
2121 SECTION 2. Section 382.055(d), Health and Safety Code, is
2222 amended to read as follows:
2323 (d) In determining whether and under which conditions a
2424 preconstruction permit should be renewed, the commission shall
2525 consider, at a minimum:
2626 (1) the performance of the owner or operator of the
2727 facility according to the method developed by the commission under
2828 Section 5.754, Water Code; [and]
2929 (2) the condition and effectiveness of existing
3030 emission control equipment and practices; and
3131 (3) the cumulative effects on the public's health and
3232 physical property of expected air contaminant emissions from the
3333 facility and from other facilities located less than three miles
3434 from the facility.
3535 SECTION 3. The changes in law made by this Act apply only to
3636 the issuance or renewal of a permit for which an application is
3737 filed with the Texas Commission on Environmental Quality on or
3838 after the effective date of this Act. The issuance or renewal of a
3939 permit for which an application is filed with the Texas Commission
4040 on Environmental Quality before the effective date of this Act is
4141 governed by the law in effect when the application is filed, and the
4242 former law is continued in effect for that purpose.
4343 SECTION 4. This Act takes effect September 1, 2025.
