88 AN ACT
99 relating to consideration of education-related income in
1010 determining eligibility of applicants for residential tenancies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 92, Property Code, is
1313 amended by adding Section 92.027 to read as follows:
1414 Sec. 92.027. CONSIDERATION OF APPLICANT'S
1515 EDUCATION-RELATED INCOME. (a) In this section, "applicant,"
1616 "landlord," and "rental application" have the meanings assigned by
1717 Section 92.351.
1818 (b) A landlord who considers an applicant's current income
1919 in determining whether to approve an application for occupancy
2020 shall:
2121 (1) include on a rental application a space labeled
2222 "EDUCATION-RELATED INCOME" for an applicant to provide information
2323 about the applicant's education-related income, including grants,
2424 scholarships, and federal student loans; and
2525 (2) consider in the calculation of current income any
2626 education-related income of the applicant provided on the rental
2727 application form.
2828 (c) A landlord who violates this section is liable to the
2929 applicant for an amount equal to the sum of $100, three times the
3030 amount of any application fee or deposit, and the applicant's
3131 reasonable attorney's fees.
3232 SECTION 2. Section 92.3515(a), Property Code, is amended to
3333 read as follows:
3434 (a) At the time an applicant is provided with a rental
3535 application, the landlord shall make available to the applicant
3636 printed notice of the landlord's tenant selection criteria and the
3737 grounds for which the rental application may be denied, including
3838 the applicant's:
3939 (1) criminal history;
4040 (2) previous rental history;
4141 (3) current income, including education-related
4242 income described by Section 92.027;
4343 (4) credit history; or
4444 (5) failure to provide accurate or complete
4545 information on the application form.
4646 SECTION 3. The changes in law made by this Act apply only to
4747 a rental application provided by a landlord to an applicant on or
4848 after the effective date of this Act. A rental application
4949 provided by a landlord to an applicant before the effective date of
5050 this Act is governed by the law in effect immediately before the
5151 effective date of this Act, and the former law is continued in
5252 effect for that purpose.
5353 SECTION 4. This Act takes effect September 1, 2025.
