77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the requirement that the board of directors of certain
1010 tax increment reinvestment zones utilize the services of the legal
1111 department of the municipality that created the zone.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 311.010, Tax Code, is amended by adding
1414 Subsection (j) to read as follows:
1515 (j) The board of directors of a reinvestment zone to which
1616 this subsection applies shall utilize the legal department of the
1717 municipality that created the zone as the zone's primary legal
1818 counsel. If the city attorney for the municipality that created the
1919 reinvestment zone determines that it is necessary, the city
2020 attorney may retain and oversee outside legal counsel for the zone.
2121 This subsection applies only to a reinvestment zone created by a
2222 municipality with a population of at least two million.
2323 SECTION 2. Section 311.010(j), Tax Code, as added by this
2424 Act, does not apply to a contract or agreement for legal services
2525 entered into before the effective date of this Act, except that
2626 Section 311.010(j), Tax Code, as added by this Act, does apply to
2727 any renewal, modification, or extension of the contract or
2828 agreement that occurs on or after the effective date of this Act.
2929 SECTION 3. This Act takes effect September 1, 2025.
