88 AN ACT
99 relating to the Center for Elimination of Disproportionality and
1010 Disparities renamed as the office for health equity and the duties
1111 of that office.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 107A, Health and Safety Code, is amended
1414 to read as follows:
1515 CHAPTER 107A. OFFICE FOR HEALTH EQUITY [CENTER FOR ELIMINATION OF
1616 DISPROPORTIONALITY AND DISPARITIES]
1717 Sec. 107A.001. DEFINITIONS. In this chapter:
1818 (1) "Office" means the office for health equity
1919 established under this chapter.
2020 (2) "Provider" has the meaning assigned by Section
2121 544.0001, Government Code.
2222 Sec. 107A.002. OFFICE FOR HEALTH EQUITY [CENTER FOR
2323 ELIMINATION OF DISPROPORTIONALITY AND DISPARITIES]. (a) The
2424 executive commissioner shall maintain an office [a center] for
2525 health equity within [elimination of disproportionality and
2626 disparities in] the commission to:
2727 (1) assume a leadership role in working or contracting
2828 with state and federal agencies, universities, private interest
2929 groups, communities, foundations, and offices of minority health to
3030 develop and implement health initiatives to promote health equity
3131 and decrease or eliminate health and health access disparities
3232 among women and racial, multicultural, disadvantaged, ethnic, and
3333 regional populations, and across age brackets and linguistic groups
3434 in this state[, including appropriate language services]; and
3535 (2) coordinate with state and federal agencies,
3636 universities, private interest groups, communities, foundations,
3737 and offices that provide health care services to women and specific
3838 minority and age groups in this state to maximize use of existing
3939 resources without duplicating existing efforts.
4040 (b) The health initiatives developed under Subsection (a)
4141 must include initiatives to increase access to appropriate language
4242 services in health care settings.
4343 Sec. 107A.003 [107A.002]. POWERS OF OFFICE [CENTER]. The
4444 office [center] may:
4545 (1) provide a central information and referral source,
4646 including a clearinghouse for health disparities information, and
4747 serve as the primary state resource in coordinating, planning,
4848 implementing, and advocating access to health care services to
4949 promote health equity and eliminate health disparities in this
5050 state;
5151 (2) coordinate conferences and other training
5252 opportunities to increase skills among state agencies and
5353 government staff in management and in the appreciation of cultural
5454 diversity;
5555 (3) pursue and administer grant funds for innovative
5656 projects for universities, communities, groups, and individuals;
5757 (4) provide recommendations and training in improving
5858 minority recruitment in state agencies;
5959 (5) publicize, implement, and disseminate information
6060 and evidence-based strategies to promote health equity and
6161 eliminate [regarding] health disparities [and minority health
6262 issues] through the use of the media;
6363 (6) network with existing minority organizations,
6464 community-based health groups, faith-based organizations, and
6565 statewide health coalitions;
6666 (7) solicit, receive, and spend grants, gifts, and
6767 donations from public and private sources; [and]
6868 (8) contract with public and private entities in the
6969 performance of its responsibilities;
7070 (9) coordinate with local health authorities to
7171 investigate and report on issues related to health and health
7272 access disparities among women and racial, multicultural, ethnic,
7373 disadvantaged, and regional populations, and across age brackets
7474 and linguistic groups in this state;
7575 (10) publish on the office's publicly accessible
7676 Internet website the results of an investigation under Subdivision
7777 (9) and any data collected during the investigation, omitting any
7878 personally identifying information;
7979 (11) monitor existing and emerging trends in
8080 behavioral health, morbidity, and mortality rates among women and
8181 racial, multicultural, ethnic, disadvantaged, and regional
8282 populations, and across age brackets and linguistic groups in this
8383 state;
8484 (12) develop and implement short-term and long-term
8585 strategies to promote health equity and eliminate health and health
8686 access disparities among women and racial, multicultural, ethnic,
8787 disadvantaged, and regional populations, and across age brackets
8888 and linguistic groups in this state;
8989 (13) monitor the progress of the commission and
9090 providers in promoting health equity and in eliminating health and
9191 health access disparities;
9292 (14) advise and assist the commission on the
9393 implementation of any programs or funding authorized by the
9494 legislature that addresses health and health access disparities;
9595 (15) examine the manner in which disparities in
9696 education, criminal justice, housing, economic opportunity,
9797 environment, and other social determinants contribute to health and
9898 health access disparities;
9999 (16) examine the effect of health and health access
100100 disparities on educational, housing, and economic opportunity; and
101101 (17) advise the commission on procuring contracts with
102102 providers who are promoting health equity and working to eliminate
103103 health and health access disparities among women and racial,
104104 multicultural, ethnic, disadvantaged, and regional populations,
105105 and across age brackets and linguistic groups in this state.
106106 Sec. 107A.004 [107A.003]. FUNDING. The commission may
107107 distribute to the office to be used in accordance with this chapter:
108108 (1) [center] unobligated and unexpended
109109 appropriations;
110110 (2) money the legislature appropriates; and
111111 (3) gifts, donations, or grants, including grants from
112112 the federal government [to be used to carry out its powers].
113113 Sec. 107A.005. PROVIDER CONTRACTS. (a) The commission
114114 shall collaborate with the office in procuring contracts and
115115 entering into provider agreements with providers who promote health
116116 equity and eliminate health and health access disparities among
117117 women and racial, multicultural, ethnic, disadvantaged, and
118118 regional populations, and across age brackets and linguistic groups
119119 in this state.
120120 (b) The office shall assist providers under a contract or
121121 provider agreement with the commission in implementing programs and
122122 strategies that promote health equity and eliminate health and
123123 health access disparities among women and racial, multicultural,
124124 ethnic, disadvantaged, and regional populations, and across age
125125 brackets and linguistic groups in this state.
126126 Sec. 107A.006. CROSS-AGENCY COLLABORATION. The office may
127127 collaborate with other state agencies to advise and assist in
128128 implementing programs and strategies that seek to eliminate social
129129 determinants contributing to health and health access disparities
130130 among women and racial, multicultural, ethnic, disadvantaged, and
131131 regional populations, and across age brackets and linguistic groups
132132 in this state.
133133 SECTION 2. This Act takes effect September 1, 2025.
