77 AN ACT
88 relating to the inspection of residential and day placement
99 facilities for special education students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1212 amended by adding Section 29.0101 to read as follows:
1313 Sec. 29.0101. INSPECTION OF RESIDENTIAL AND DAY PLACEMENT
1414 FACILITIES. In conducting an inspection in accordance with the
1515 monitoring system adopted under Section 29.010 of a residential
1616 placement or day placement facility with which a school district
1717 contracts to provide services to students with disabilities, the
1818 agency shall consider whether:
1919 (1) educational services provided to a student placed
2020 in a therapeutic environment in a residential or day placement at
2121 the facility align with medical standards of care and best
2222 practices for children with the student's disability; and
2323 (2) employees of the facility have undergone and
2424 adhere to crisis prevention and intervention training.
2525 SECTION 2. This Act applies beginning with the 2025-2026
2626 school year.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2025.
