| 8 | 8 | | relating to the inspection of residential and day placement |

| 9 | 9 | | facilities for special education students. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 29, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 29.0101 to read as follows: |
|---|
| 13 | 13 | | Sec. 29.0101. INSPECTION OF RESIDENTIAL AND DAY PLACEMENT |
|---|
| 14 | 14 | | FACILITIES. In conducting an inspection in accordance with the |
|---|
| 15 | 15 | | monitoring system adopted under Section 29.010 of a residential |
|---|
| 16 | 16 | | placement or day placement facility with which a school district |
|---|
| 17 | 17 | | contracts to provide services to students with disabilities, the |
|---|
| 18 | 18 | | agency shall consider whether: |
|---|
| 19 | 19 | | (1) educational services provided to a student placed |
|---|
| 20 | 20 | | in a therapeutic environment in a residential or day placement at |
|---|
| 21 | 21 | | the facility align with medical standards of care and best |
|---|
| 22 | 22 | | practices for children with the student's disability; and |
|---|
| 23 | 23 | | (2) employees of the facility have undergone and |
|---|
| 24 | 24 | | adhere to crisis prevention and intervention training. |
|---|
| 25 | 25 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 26 | 26 | | school year. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2025. |
