9 | 9 | relating to the authority of certain health care facilities to | |
10 | 10 | cooperate with officers engaged in immigration-related duties. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subtitle F, Title 4, Health and Safety Code, is | |
13 | 13 | amended by adding Chapter 318 to read as follows: | |
14 | 14 | CHAPTER 318. COOPERATION WITH OFFICERS ENGAGED IN | |
15 | 15 | IMMIGRATION-RELATED DUTIES | |
16 | 16 | Sec. 318.001. DEFINITION. In this chapter, "health | |
17 | 17 | facility" means: | |
18 | 18 | (1) a hospital licensed under Chapter 241; | |
19 | 19 | (2) a health care facility owned or operated by a | |
20 | 20 | hospital district; and | |
21 | 21 | (3) a federally qualified health center as defined by | |
22 | 22 | 42 U.S.C. Section 1396d(l)(2)(B). | |
23 | 23 | Sec. 318.002. COOPERATION WITH OFFICER ENGAGED IN | |
24 | 24 | IMMIGRATION-RELATED DUTIES PROHIBITED. A health facility may not | |
25 | 25 | grant a federal immigration officer or peace officer engaged in | |
26 | 26 | immigration-related investigation or enforcement duties access to | |
27 | 27 | the premises of the facility without a judicial warrant. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
