| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 382.051991 to read as follows: |
|---|
| 14 | 14 | | Sec. 382.051991. MUNICIPAL OR COUNTY APPROVAL OF CERTAIN |
|---|
| 15 | 15 | | CONCRETE FACILITIES. (a) This section applies only to an |
|---|
| 16 | 16 | | application for a permit or an authorization to use a permit for a |
|---|
| 17 | 17 | | facility that is: |
|---|
| 18 | 18 | | (1) a concrete crushing facility or a concrete plant |
|---|
| 19 | 19 | | that performs wet batching, dry batching, or central mixing; and |
|---|
| 20 | 20 | | (2) located or proposed to be located in: |
|---|
| 21 | 21 | | (A) an incorporated area of a municipality that |
|---|
| 22 | 22 | | has not adopted zoning regulations and has a population of more than |
|---|
| 23 | 23 | | two million; or |
|---|
| 24 | 24 | | (B) an unincorporated area of a county with a |
|---|
| 25 | 25 | | population of more than 4.5 million. |
|---|
| 26 | 26 | | (b) This section does not apply to an application for an |
|---|
| 27 | 27 | | authorization to use a standard permit under Section 382.051985. |
|---|
| 28 | 28 | | (c) For each application described by Subsection (a), the |
|---|
| 29 | 29 | | commission: |
|---|
| 30 | 30 | | (1) shall send to the governing body of the |
|---|
| 31 | 31 | | municipality or county, as applicable, a copy of the application; |
|---|
| 32 | 32 | | and |
|---|
| 33 | 33 | | (2) may not issue the permit or authorize the use of |
|---|
| 34 | 34 | | the permit before the 31st day after the date the governing body |
|---|
| 35 | 35 | | receives the copy unless the commission receives notice that the |
|---|
| 36 | 36 | | governing body has approved the application. |
|---|
| 37 | 37 | | (d) The commission may not issue a permit or authorize the |
|---|
| 38 | 38 | | use of a permit under Section 382.0518, 382.05195, 382.05196, or |
|---|
| 39 | 39 | | 382.05198 or another provision of this chapter for a facility |
|---|
| 40 | 40 | | described by Subsection (a) if the commission receives, before the |
|---|
| 41 | 41 | | 31st day after the date the governing body receives the copy of the |
|---|
| 42 | 42 | | application from the commission, notice that the governing body has |
|---|
| 43 | 43 | | rejected the application. |
|---|
| 44 | 44 | | SECTION 2. Section 382.051991, Health and Safety Code, as |
|---|
| 45 | 45 | | added by this Act, applies only to a permit or authorization the |
|---|
| 46 | 46 | | application for which is filed with the Texas Commission on |
|---|
| 47 | 47 | | Environmental Quality on or after the effective date of this Act. A |
|---|
| 48 | 48 | | permit or authorization the application for which is filed before |
|---|
| 49 | 49 | | the effective date of this Act is governed by the law in effect on |
|---|
| 50 | 50 | | the date of filing, and that law is continued in effect for that |
|---|
| 51 | 51 | | purpose. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect September 1, 2025. |
|---|
