77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to benefits provided to eligible survivors of certain
1010 public safety employees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 615.021(a), Government Code, is amended
1313 to read as follows:
1414 (a) A survivor of an individual listed under Section 615.003
1515 is eligible for the payment of assistance under this chapter if:
1616 (1) the listed individual:
1717 (A) died as a result of a personal injury
1818 sustained in the line of duty in the individual's position as
1919 described by Section 615.003; or
2020 (B) died as a result of an acute myocardial
2121 infarction or stroke during or not later than 24 hours after the
2222 performance of actions in the line of duty in the individual's
2323 position as described by Section 615.003; and
2424 (2) the survivor is:
2525 (A) the surviving spouse of the listed
2626 individual;
2727 (B) a surviving child of the listed individual,
2828 if there is no surviving spouse; or
2929 (C) a surviving parent of the listed individual,
3030 if there is no surviving spouse or child.
3131 SECTION 2. The changes in law made by this Act to Section
3232 615.021, Government Code, apply only in relation to a death that
3333 occurs on or after the effective date of this Act. Matters
3434 regarding eligibility under Chapter 615, Government Code, in
3535 relation to a death that occurs before the effective date of this
3636 Act, are governed by the law in effect on the date the death
3737 occurred, and the former law is continued in effect for that
3838 purpose.
3939 SECTION 3. This Act takes effect September 1, 2025.
