77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the renewal of certain leases in manufactured home
1010 communities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 94, Property Code, is
1313 amended by adding Section 94.2041 to read as follows:
1414 Sec. 94.2041. NONRENEWAL OF LEASE FOR CERTAIN TENANTS WITH
1515 MINOR CHILDREN. (a) This section applies only to a lease
1616 agreement:
1717 (1) with a tenant:
1818 (A) who resides in the manufactured home with a
1919 minor child; or
2020 (B) whose tenant residing in the manufactured
2121 home resides in the manufactured home with a minor child; and
2222 (2) the expiration of which would occur during a
2323 semester of school as determined by the local school district.
2424 (b) A landlord that chooses not to renew a lease agreement
2525 described by Subsection (a) shall:
2626 (1) convert the lease to a month-to-month lease; and
2727 (2) renew the month-to-month lease every month until
2828 the end of the lease would occur outside of a period described by
2929 Subsection (a)(2).
3030 SECTION 2. The changes in law made by this Act apply only to
3131 a lease agreement entered into or renewed on or after the effective
3232 date of this Act.
3333 SECTION 3. This Act takes effect September 1, 2025.
