10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 1201.2055(a), Occupations Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | (a) In completing an application for the issuance of a | |
14 | 14 | statement of ownership, an owner of a manufactured home shall | |
15 | 15 | indicate whether the owner elects to treat the home as real | |
16 | 16 | property. An owner may elect to treat a manufactured home as real | |
17 | 17 | property only if the home is: | |
18 | 18 | (1) attached to: | |
19 | 19 | (A) [(1)] real property that is owned by the | |
20 | 20 | owner of the home; or | |
21 | 21 | (B) [(2)] land leased to the owner of the home | |
22 | 22 | under a long-term lease, as defined by department rule; or | |
23 | 23 | (2) occupied by the owner of the home as the owner's | |
24 | 24 | primary residence. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2025. |
