66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to equitable representation in decision making for
99 transportation planning.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 201.05l(b) and (i), Transportation Code, are
1212 amended to read as follows:
1313 (b) The members shall be appointed to reflect the diverse
1414 geographic regions and population groups of this state. One member
1515 must reside in a rural area and be a registered voter of a county
1616 with a population of less than 150,000. One member must have
1717 experience as a frequent transit user, bicycle or pedestrian
1818 commuter, or as a person with a disability that has affected their
1919 use of the transportation system.
2020 (i) Appointments to the commission shall [be made without
2121 regard to race, color, disability, sex, religion, age, or national
2222 origin of the appointees and shall] reflect the diversity of the
2323 population of the state as a whole.
2424 SECTION 2. Subchapter H, Chapter 201, Transportation Code,
2525 is amended by adding Section 201.6016 to read as follows:
2626 Sec. 201.6016. EQUITABLE DECISION MAKING POLICY. The
2727 department shall develop and implement a policy for equitable
2828 decision making in the transportation planning process. The policy
2929 must:
3030 (1) analyze race, ethnicity, gender, disability, and
3131 geographic representation in positions and on boards, commissions,
3232 and committees responsible for transportation planning-related
3333 decisions, including:
3434 (A) metropolitan planning organization
3535 committees;
3636 (B) department executive leadership;
3737 (C) the commission; and
3838 (D) governing bodies of:
3939 (i) regional mobility authorities, county
4040 toll road authorities, and regional tollway authorities;
4141 (ii) transit authorities; and
4242 (iii) port authorities;
4343 (2) analyze public participation in the department's
4444 planning processes to ensure people of all races, ethnicities,
4545 genders, abilities, socio-economic status, languages, and
4646 geographic locations are successfully participating in those
4747 processes; and
4848 (3) establish guidelines for the entities under
4949 Subdivision (1) to achieve equitable representation, including at
5050 least the following:
5151 (A) proposing new joint powers agreements and
5252 bylaws to remedy problems;
5353 (B) guidance on improving public processes;
5454 (C) guidance for adopting proportional voting
5555 systems based upon residential populations of member governments to
5656 provide equal representation for all residents in decisions of
5757 entities such as metropolitan planning organizations; and
5858 (D) guidance for entities to include people with
5959 disabilities at all levels of decision making.
6060 SECTION 3. This Act takes effect September 1, 2021.
