77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dissemination of juvenile justice information by
1010 the Texas Juvenile Justice Department.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 58.009(c) and (f-1), Family Code, are
1313 amended to read as follows:
1414 (c) The Texas Juvenile Justice Department may grant access
1515 to juvenile justice information[:
1616 [(1)] for research and statistical purposes or for any
1717 other purpose approved by the department to:
1818 (1) [(A)] criminal justice agencies as defined by
1919 Section 411.082, Government Code;
2020 (2) [(B)] the Texas Education Agency, as authorized
2121 under Section 37.084, Education Code;
2222 (3) [(C)] any agency under the authority of the Health
2323 and Human Services Commission; [or]
2424 (4) [(D)] the Department of Family and Protective
2525 Services; or
2626 (5) a public or private university
2727 [(2) for a purpose beneficial to and approved by the
2828 department to an individual or entity that:
2929 [(A) is working on a research or statistical
3030 project that meets the requirements of and is approved by the
3131 department; and
3232 [(B) has a specific agreement with the department
3333 that:
3434 [(i) specifically authorizes access to
3535 identifiable juvenile justice information;
3636 [(ii) limits the use of the information to
3737 the purposes for which the information is given;
3838 [(iii) ensures the security and
3939 confidentiality of the information; and
4040 [(iv) provides for sanctions if a
4141 requirement imposed under Subparagraph (i), (ii), or (iii) is
4242 violated].
4343 (f-1) In accordance with Chapter 552, Government Code, the
4444 Texas Juvenile Justice Department may grant access to juvenile
4545 justice information that is not identifiable information for
4646 research or statistical purposes or for any other purpose approved
4747 by the department to:
4848 (1) criminal justice agencies as defined by Section
4949 411.082, Government Code;
5050 (2) the Texas Education Agency, as authorized under
5151 Section 37.084, Education Code;
5252 (3) any agency under the authority of the Health and
5353 Human Services Commission;
5454 (4) the Department of Family and Protective Services;
5555 or
5656 (5) a public or private university[; or
5757 [(6) an individual or entity working on a research or
5858 statistical project].
5959 SECTION 2. This Act takes effect September 1, 2025.
