11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 5016.0051, Special District Local Laws |
---|
13 | 13 | | Code, is amended to read as follows: |
---|
14 | 14 | | Sec. 5016.0051. COMPOSITION OF PORT COMMISSION. The port |
---|
15 | 15 | | commission is composed of nine [seven] port commissioners. |
---|
16 | 16 | | SECTION 2. Section 5016.0052(a), Special District Local |
---|
17 | 17 | | Laws Code, is amended to read as follows: |
---|
18 | 18 | | (a) Port commissioners are appointed as follows: |
---|
19 | 19 | | (1) the Commissioners Court of Nueces County shall |
---|
20 | 20 | | appoint three port commissioners; |
---|
21 | 21 | | (2) the city council of the City of Corpus Christi |
---|
22 | 22 | | shall appoint three port commissioners; [and] |
---|
23 | 23 | | (3) the Commissioners Court of San Patricio County |
---|
24 | 24 | | shall appoint one port commissioner; |
---|
25 | 25 | | (4) the city council of the City of Portland shall |
---|
26 | 26 | | appoint one port commissioner; and |
---|
27 | 27 | | (5) the city council of the City of Port Aransas shall |
---|
28 | 28 | | appoint one port commissioner. |
---|
29 | 29 | | SECTION 3. Not later than January 1, 2026, the city councils |
---|
30 | 30 | | of the City of Portland and the City of Port Aransas shall each |
---|
31 | 31 | | appoint one port commissioner to the port commission of the Port of |
---|
32 | 32 | | Corpus Christi Authority of Nueces County, Texas, as provided by |
---|
33 | 33 | | Section 5016.0052(a), Special District Local Laws Code, as amended |
---|
34 | 34 | | by this Act, to serve terms that expire on dates that preserve the |
---|
35 | 35 | | required staggering of terms. |
---|
36 | 36 | | SECTION 4. (a) The legal notice of the intention to |
---|
37 | 37 | | introduce this Act, setting forth the general substance of this |
---|
38 | 38 | | Act, has been published as provided by law, and the notice and a |
---|
39 | 39 | | copy of this Act have been furnished to all persons, agencies, |
---|
40 | 40 | | officials, or entities to which they are required to be furnished |
---|
41 | 41 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
42 | 42 | | Government Code. |
---|
43 | 43 | | (b) The governor, one of the required recipients, has |
---|
44 | 44 | | submitted the notice and Act to the Texas Commission on |
---|
45 | 45 | | Environmental Quality. |
---|
46 | 46 | | (c) The Texas Commission on Environmental Quality has filed |
---|
47 | 47 | | its recommendations relating to this Act with the governor, the |
---|
48 | 48 | | lieutenant governor, and the speaker of the house of |
---|
49 | 49 | | representatives within the required time. |
---|
50 | 50 | | (d) All requirements of the constitution and laws of this |
---|
51 | 51 | | state and the rules and procedures of the legislature with respect |
---|
52 | 52 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
53 | 53 | | and accomplished. |
---|
54 | 54 | | SECTION 5. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2025. |
