66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to a signed acknowledgment of the duties of a member of the
99 Texas Lottery Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 466, Government Code, is
1212 amended by adding Section 466.0151 to read as follows:
1313 Sec. 466.0151. ACKNOWLEDGMENT OF COMMISSION MEMBER DUTIES.
1414 (a) An individual appointed as a member of the commission shall, as
1515 soon as practicable after the individual's term begins:
1616 (1) sign the acknowledgment described by this section
1717 prepared and provided by the executive director; and
1818 (2) submit the signed acknowledgment to the executive
1919 director for retention by the commission for the member's term.
2020 (b) Each member of the commission must sign a statement in
2121 the following form:
2222 "ACKNOWLEDGMENT OF DUTIES OF TEXAS LOTTERY COMMISSION MEMBER
2323 "I hereby acknowledge that I have read and understand the duties of
2424 an appointed member of the Texas Lottery Commission.
2525 (a) "I understand the statutory responsibility to adopt
2626 rules consistent with Government Code 466, and I shall do so under
2727 strict interpretation.
2828 (b) "I understand that the statutory responsibilities
2929 include adopting rules governing the:
3030 "(1) security for the lottery and the commission,
3131 including the development of an internal security plan;
3232 "(2) apportionment of the total revenues from the sale
3333 of tickets and from all other sources in the amounts provided by
3434 Chapter 466, Government Code;
3535 "(3) enforcement of prohibitions on the sale of tickets
3636 to or by an individual younger than 18 years of age;
3737 "(4) enforcement of prohibitions on a person playing a
3838 lottery game by telephone; and
3939 "(5) nondisclosure of the personally identifiable
4040 information of certain lottery prize winners under Section 466.411,
4141 Government Code.
4242 (c) "I understand that the duties of a commission member may
4343 include adopting rules regarding the establishment and operation of
4444 the lottery, including rules governing:
4545 "(1) the type of lottery games to be conducted;
4646 "(2) the price of each ticket;
4747 "(3) the number of winning tickets and amount of the
4848 prize paid on each winning ticket;
4949 "(4) the frequency of the drawing or selection of a
5050 winning ticket;
5151 "(5) the number and types of locations at which a ticket
5252 may be sold;
5353 "(6) the method to be used in selling a ticket;
5454 "(7) the use of vending machines or electronic or
5555 mechanical devices of any kind, other than machines or devices that
5656 dispense currency or coins as prizes;
5757 "(8) the manner of paying a prize to the holder of a
5858 winning ticket;
5959 "(9) the investigation of possible violations of
6060 Chapter 466, Government Code, or any rule adopted under that
6161 chapter;
6262 "(10) the means of advertising to be used for the
6363 lottery;
6464 "(11) the qualifications of vendors of lottery
6565 services or equipment;
6666 "(12) the confidentiality of information relating to
6767 the operation of the lottery, including:
6868 "(A) trade secrets;
6969 "(B) security measures, systems, or procedures;
7070 "(C) security reports;
7171 "(D) bids or other information regarding the
7272 commission's contracts, if disclosure of the information would
7373 impair the commission's ability to contract for facilities, goods,
7474 or services on terms favorable to the commission;
7575 "(E) personnel information unrelated to
7676 compensation, duties, qualifications, or responsibilities; and
7777 "(F) information obtained by commission security
7878 officers or investigators;
7979 "(13) the development and availability of a model
8080 agreement governing the division of a prize among multiple
8181 purchasers of a winning ticket purchased through a group purchase
8282 or pooling arrangement;
8383 "(14) the criteria to be used in evaluating bids for
8484 contracts for lottery facilities, goods, and services; and
8585 "(15) any other matter necessary or desirable, as
8686 determined by the commission, to promote and ensure:
8787 "(A) the integrity, security, honesty, and
8888 fairness of the operation and administration of the lottery; and
8989 "(B) the convenience of players and holders of
9090 winning tickets."
9191 (c) A member of the commission whose term began before
9292 September 1, 2025, shall sign the acknowledgment form under this
9393 section as soon as practicable. This subsection expires January 1,
9494 2026.
9595 SECTION 2. This Act takes effect September 1, 2025.
