7	7	AN ACT
8	8	relating to a signed acknowledgment of the duties of a member of the
9	9	Texas Lottery Commission.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter B, Chapter 466, Government Code, is
12	12	amended by adding Section 466.0151 to read as follows:
13	13	Sec. 466.0151. ACKNOWLEDGMENT OF COMMISSION MEMBER DUTIES.
14	14	(a) An individual appointed as a member of the commission shall, as
15	15	soon as practicable after the individual's term begins:
16	16	(1) sign the acknowledgment described by this section
17	17	prepared and provided by the executive director; and
18	18	(2) submit the signed acknowledgment to the executive
19	19	director for retention by the commission for the member's term.
20	20	(b) Each member of the commission must sign a statement in
21	21	the following form:
22	22	"ACKNOWLEDGMENT OF DUTIES OF TEXAS LOTTERY COMMISSION MEMBER
23	23	"I hereby acknowledge that I have read and understand the duties of
24	24	an appointed member of the Texas Lottery Commission.
25	25	(a) "I understand the statutory responsibility to adopt
26	26	rules consistent with Government Code 466, and I shall do so under
27	27	strict interpretation.
28	28	(b) "I understand that the statutory responsibilities
29	29	include adopting rules governing the:
30	30	"(1) security for the lottery and the commission,
31	31	including the development of an internal security plan;
32	32	"(2) apportionment of the total revenues from the sale
33	33	of tickets and from all other sources in the amounts provided by
34	34	Chapter 466, Government Code;
35	35	"(3) enforcement of prohibitions on the sale of tickets
36	36	to or by an individual younger than 18 years of age;
37	37	"(4) enforcement of prohibitions on a person playing a
38	38	lottery game by telephone; and
39	39	"(5) nondisclosure of the personally identifiable
40	40	information of certain lottery prize winners under Section 466.411,
41	41	Government Code.
42	42	(c) "I understand that the duties of a commission member may
43	43	include adopting rules regarding the establishment and operation of
44	44	the lottery, including rules governing:
45	45	"(1) the type of lottery games to be conducted;
46	46	"(2) the price of each ticket;
47	47	"(3) the number of winning tickets and amount of the
48	48	prize paid on each winning ticket;
49	49	"(4) the frequency of the drawing or selection of a
50	50	winning ticket;
51	51	"(5) the number and types of locations at which a ticket
52	52	may be sold;
53	53	"(6) the method to be used in selling a ticket;
54	54	"(7) the use of vending machines or electronic or
55	55	mechanical devices of any kind, other than machines or devices that
56	56	dispense currency or coins as prizes;
57	57	"(8) the manner of paying a prize to the holder of a
58	58	winning ticket;
59	59	"(9) the investigation of possible violations of
60	60	Chapter 466, Government Code, or any rule adopted under that
61	61	chapter;
62	62	"(10) the means of advertising to be used for the
63	63	lottery;
64	64	"(11) the qualifications of vendors of lottery
65	65	services or equipment;
66	66	"(12) the confidentiality of information relating to
67	67	the operation of the lottery, including:
68	68	"(A) trade secrets;
69	69	"(B) security measures, systems, or procedures;
70	70	"(C) security reports;
71	71	"(D) bids or other information regarding the
72	72	commission's contracts, if disclosure of the information would
73	73	impair the commission's ability to contract for facilities, goods,
74	74	or services on terms favorable to the commission;
75	75	"(E) personnel information unrelated to
76	76	compensation, duties, qualifications, or responsibilities; and
77	77	"(F) information obtained by commission security
78	78	officers or investigators;
79	79	"(13) the development and availability of a model
80	80	agreement governing the division of a prize among multiple
81	81	purchasers of a winning ticket purchased through a group purchase
82	82	or pooling arrangement;
83	83	"(14) the criteria to be used in evaluating bids for
84	84	contracts for lottery facilities, goods, and services; and
85	85	"(15) any other matter necessary or desirable, as
86	86	determined by the commission, to promote and ensure:
87	87	"(A) the integrity, security, honesty, and
88	88	fairness of the operation and administration of the lottery; and
89	89	"(B) the convenience of players and holders of
90	90	winning tickets."
91	91	(c) A member of the commission whose term began before
92	92	September 1, 2025, shall sign the acknowledgment form under this
93	93	section as soon as practicable. This subsection expires January 1,
94	94	2026.
95	95	SECTION 2. This Act takes effect September 1, 2025.
