12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Subchapter C, Chapter 5, Water Code, is amended | |
14 | 14 | by adding Section 5.062 to read as follows: | |
15 | 15 | Sec. 5.062. CERTAIN EMPLOYMENT FOR FORMER EMPLOYEE | |
16 | 16 | RESTRICTED. A former commission employee may not accept employment | |
17 | 17 | in an industry regulated by the commission, as described in Section | |
18 | 18 | 5.013(a), before the second anniversary of the date the person | |
19 | 19 | ceased to be a commission employee. | |
20 | 20 | SECTION 2. Section 7.052, Water Code, is amended by adding | |
21 | 21 | Subsection (b-5) to read as follows: | |
22 | 22 | (b-5) A person who hires a former commission employee in | |
23 | 23 | violation of Section 5.062 is subject to an administrative penalty | |
24 | 24 | not to exceed an amount that is equal to three times the employee's | |
25 | 25 | salary for the position hired. | |
26 | 26 | SECTION 3. Section 5.062, Water Code, as added by this Act, | |
27 | 27 | applies only to a person who ceases to be a Texas Commission on | |
28 | 28 | Environmental Quality employee on or after the effective date of | |
29 | 29 | this Act. | |
30 | 30 | SECTION 4. This Act takes effect September 1, 2025. |
