77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to employment restrictions for former Texas Commission on
1010 Environmental Quality employees; providing an administrative
1111 penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 5, Water Code, is amended
1414 by adding Section 5.062 to read as follows:
1515 Sec. 5.062. CERTAIN EMPLOYMENT FOR FORMER EMPLOYEE
1616 RESTRICTED. A former commission employee may not accept employment
1717 in an industry regulated by the commission, as described in Section
1818 5.013(a), before the second anniversary of the date the person
1919 ceased to be a commission employee.
2020 SECTION 2. Section 7.052, Water Code, is amended by adding
2121 Subsection (b-5) to read as follows:
2222 (b-5) A person who hires a former commission employee in
2323 violation of Section 5.062 is subject to an administrative penalty
2424 not to exceed an amount that is equal to three times the employee's
2525 salary for the position hired.
2626 SECTION 3. Section 5.062, Water Code, as added by this Act,
2727 applies only to a person who ceases to be a Texas Commission on
2828 Environmental Quality employee on or after the effective date of
2929 this Act.
3030 SECTION 4. This Act takes effect September 1, 2025.
