12 | 18 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 19 | | SECTION 1. Section 51.332, Education Code, is amended to |
---|
14 | 20 | | read as follows: |
---|
15 | 21 | | Sec. 51.332. APPLICABILITY. This subchapter does not apply |
---|
16 | 22 | | to: |
---|
17 | 23 | | (1) a student who has graduated with an associate or |
---|
18 | 24 | | baccalaureate degree from an institution of higher education; |
---|
19 | 25 | | (2) a student who transfers to an institution of |
---|
20 | 26 | | higher education from a private or independent institution of |
---|
21 | 27 | | higher education or an accredited out-of-state institution of |
---|
22 | 28 | | higher education and who has satisfactorily completed |
---|
23 | 29 | | college-level coursework; |
---|
24 | 30 | | (3) a student who is enrolled in a certificate program |
---|
25 | 31 | | of one year or less at a public junior college, a public technical |
---|
26 | 32 | | institute, or a public state college; |
---|
27 | 33 | | (4) a student who is serving on active duty as a member |
---|
28 | 34 | | of: |
---|
29 | 35 | | (A) the armed forces of the United States; or |
---|
30 | 36 | | (B) the Texas National Guard; |
---|
31 | 37 | | (5) a student who is currently serving as and, for at |
---|
32 | 38 | | least the three-year period preceding enrollment, has served as a |
---|
33 | 39 | | member of a reserve component of the armed forces of the United |
---|
34 | 40 | | States; [or] |
---|
35 | 41 | | (6) a student who on or after August 1, 1990, was |
---|
36 | 42 | | honorably discharged, retired, or released from: |
---|
37 | 43 | | (A) active duty as a member of the armed forces of |
---|
38 | 44 | | the United States or the Texas National Guard; or |
---|
39 | 45 | | (B) service as a member of a reserve component of |
---|
40 | 46 | | the armed forces of the United States; |
---|
41 | 47 | | (7) a student who is: |
---|
42 | 48 | | (A) certified as an emergency medical technician |
---|
43 | 49 | | under Chapter 773, Health and Safety Code; and |
---|
44 | 50 | | (B) employed by a political subdivision; |
---|
45 | 51 | | (8) a student who is included as fire protection |
---|
46 | 52 | | personnel by Section 419.021, Government Code; or |
---|
47 | 53 | | (9) a student who is elected, appointed, or employed |
---|
48 | 54 | | to serve as a peace officer described by Article 2A.001, Code of |
---|
49 | 55 | | Criminal Procedure, or other law. |
---|
50 | 56 | | SECTION 2. The change in law made by this Act applies |
---|
51 | 57 | | beginning with the assessment of entering undergraduate students at |
---|
52 | 58 | | public institutions of higher education for the 2025 fall semester. |
---|
53 | 59 | | The assessment of an entering undergraduate student for an academic |
---|
54 | 60 | | term before that semester is covered by the law in effect before the |
---|
55 | 61 | | effective date of this Act, and that law is continued in effect for |
---|
56 | 62 | | that purpose. |
---|
57 | 63 | | SECTION 3. This Act takes effect immediately if it receives |
---|
58 | 64 | | a vote of two-thirds of all the members elected to each house, as |
---|
59 | 65 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
60 | 66 | | Act does not receive the vote necessary for immediate effect, this |
---|
61 | 67 | | Act takes effect September 1, 2025. |
