77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the criminal penalty for the offense of
1010 reckless driving.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 545.401, Transportation Code, is amended
1313 by amending Subsection (b) and adding Subsections (b-1), (e), and
1414 (f) to read as follows:
1515 (b) Subject to Subsection (b-1), an [An] offense under this
1616 section is a misdemeanor punishable by:
1717 (1) a fine not to exceed $200;
1818 (2) confinement in county jail for not more than 30
1919 days; or
2020 (3) both the fine and the confinement.
2121 (b-1) Notwithstanding Subsection (b), an offense under this
2222 section is:
2323 (1) a state jail felony if it is shown on the trial of
2424 the offense that another person suffered bodily injury as a result
2525 of the offense; and
2626 (2) a felony of the third degree if it is shown on the
2727 trial of the offense that another person suffered serious bodily
2828 injury as a result of the offense.
2929 (e) If conduct that constitutes an offense under this
3030 section also constitutes an offense under any other law, the actor
3131 may be prosecuted under this section, the other law, or both.
3232 (f) In this section, "bodily injury" and "serious bodily
3333 injury" have the meanings assigned by Section 1.07, Penal Code.
3434 SECTION 2. The change in law made by this Act applies only
3535 to an offense committed on or after the effective date of this Act.
3636 An offense committed before the effective date of this Act is
3737 governed by the law in effect on the date the offense was committed,
3838 and the former law is continued in effect for that purpose. For
3939 purposes of this section, an offense was committed before the
4040 effective date of this Act if any element of the offense occurred
4141 before that date.
4242 SECTION 3. This Act takes effect September 1, 2025.
