77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to courses to understand the United States and Texas
1010 Constitutions for high school students in public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 28.002(a), Education Code, is amended to
1313 read as follows:
1414 (a) Each school district that offers kindergarten through
1515 grade 12 shall offer, as a required curriculum:
1616 (1) a foundation curriculum that includes:
1717 (A) English language arts;
1818 (B) mathematics;
1919 (C) science; and
2020 (D) social studies, consisting of Texas, United
2121 States, and world history, government, United States Constitution
2222 and Texas Constitution, economics, with emphasis on the free
2323 enterprise system and its benefits, and geography; and
2424 (2) an enrichment curriculum that includes:
2525 (A) to the extent possible, languages other than
2626 English;
2727 (B) health, with emphasis on:
2828 (i) physical health, including the
2929 importance of proper nutrition and exercise;
3030 (ii) mental health, including instruction
3131 about mental health conditions, substance abuse, skills to manage
3232 emotions, establishing and maintaining positive relationships, and
3333 responsible decision-making; and
3434 (iii) suicide prevention, including
3535 recognizing suicide-related risk factors and warning signs;
3636 (C) physical education;
3737 (D) fine arts;
3838 (E) career and technology education;
3939 (F) technology applications; and
4040 (G) religious literature, including the Hebrew
4141 Scriptures (Old Testament) and New Testament, and its impact on
4242 history and literature, and,
4343 SECTION 2. Section 28.0021(b), Education Code, is amended
4444 to read as follows:
4545 (b) Each school district and each open-enrollment charter
4646 school that offers a high school program shall provide a [an
4747 elective] course in The United States Constitution and the Texas
4848 Constitution that meets the requirements for a one-half social
4949 studies [elective] credit under Section 28.025, using materials
5050 approved by the State Board of Education. In fulfilling the
5151 requirement to provide financial literacy instruction under this
5252 section, a school district or open-enrollment charter school may
5353 use an existing state, federal, private, or nonprofit program that
5454 provides students without charge the instruction described under
5555 this section.
5656 SECTION 3. Sections 28.025(b-1) and (b-23), Education Code,
5757 are amended to read as follows:
5858 (b-1) The State Board of Education by rule shall require
5959 that the curriculum requirements for the foundation high school
6060 program under Subsection (a) include a requirement that students
6161 successfully complete:
6262 (1) four credits in English language arts under
6363 Section 28.002(a)(1)(A), including one credit in English I, one
6464 credit in English II, one credit in English III, and one credit in
6565 an advanced English course authorized under Subsection (b-2);
6666 (2) three credits in mathematics under Section
6767 28.002(a)(1)(B), including one credit in Algebra I, one credit in
6868 geometry, and one credit in any advanced mathematics course
6969 authorized under Subsection (b-2);
7070 (3) three credits in science under Section
7171 28.002(a)(1)(C), including one credit in biology, one credit in any
7272 advanced science course authorized under Subsection (b-2), and one
7373 credit in integrated physics and chemistry or in an additional
7474 advanced science course authorized under Subsection (b-2);
7575 (4) three credits in social studies under Section
7676 28.002(a)(1)(D), including one credit in United States history, at
7777 least one-half credit in government and at least one-half credit in
7878 [economics or] The United States Constitution and the Texas
7979 Constitution [& economics], and one credit in economics, world
8080 geography, or world history;
8181 (5) except as provided under Subsections (b-12),
8282 (b-13), and (b-14), two credits in the same language in a language
8383 other than English under Section 28.002(a)(2)(A);
8484 (6) five elective credits;
8585 (7) one credit in fine arts under Section
8686 28.002(a)(2)(D); and
8787 (8) except as provided by Subsection (b-11), one
8888 credit in physical education under Section 28.002(a)(2)(C).
8989 (b-23) The agency shall:
9090 (1) develop a list of free, open-source, and publicly
9191 available curricula that may be used by a school district to provide
9292 a United States Constitution and Texas Constitution [& economics]
9393 course that satisfies the curriculum requirement under Subsection
9494 (b-1)(4); and
9595 (2) seek, accept, and spend any federal or private
9696 grant funds and gifts that are available for the purpose of
9797 providing a United States Constitution and Texas Constitution [&
9898 economics] course as part of the foundation high school program.
9999 SECTION 4. Section 28.025(b-22), Education Code, is
100100 repealed.
101101 SECTION 5. Sections 28.0021(b) and 28.025(b-1), Education
102102 Code, as amended by this Act, apply only to students entering the
103103 ninth grade during the 2025-2026 school year or a later school year.
104104 For students entering a grade above ninth grade during the
105105 2025-2026 school year, Sections 28.0021(b) and 28.025(b-1),
106106 Education Code, as those sections existed before amendment by this
107107 Act, apply, and those sections are continued in effect for that
108108 purpose.
109109 SECTION 6. This Act applies beginning with the 2025-2026
110110 school year.
111111 SECTION 7. This Act takes effect immediately if it receives
112112 a vote of two-thirds of all the members elected to each house, as
113113 provided by Section 39, Article III, Texas Constitution. If this
114114 Act does not receive the vote necessary for immediate effect, this
115115 Act takes effect September 1, 2025.
