88 AN ACT
99 relating to the definition of a sexually oriented business;
1010 imposing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 102.001, Business and Commerce Code, is
1313 amended to read as follows:
1414 Sec. 102.051. DEFINITIONS. In this subchapter:
1515 (1) "Nude" means:
1616 (A) entirely unclothed; or
1717 (B) clothed in a manner that leaves uncovered or
1818 visible through less than fully opaque clothing any portion of the
1919 breasts below the top of the areola of the breasts, if the person is
2020 female, or any portion of the genitals or buttocks.
2121 (2) "Sexually oriented business" means:
2222 (A) a nightclub, bar, restaurant, or similar
2323 commercial enterprise that:
2424 [(A)] (i) provides for an audience of two or more
2525 individuals live nude entertainment or live nude performances; and
2626 [(B)] (ii) authorizes on-premises consumption of
2727 alcoholic beverages, regardless of whether the consumption of
2828 alcoholic beverages is under a license or permit issued under the
2929 Alcoholic Beverage Code; or
3030 (B) a business or commercial enterprise that engages
3131 in or hosts any activity defined as a "sexually oriented
3232 performance" under Section 43.28, Penal Code.
3333 SECTION 2. This Act takes effect September 1, 2025.
