| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 102.001, Business and Commerce Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 102.051. DEFINITIONS. In this subchapter: |
|---|
| 15 | 15 | | (1) "Nude" means: |
|---|
| 16 | 16 | | (A) entirely unclothed; or |
|---|
| 17 | 17 | | (B) clothed in a manner that leaves uncovered or |
|---|
| 18 | 18 | | visible through less than fully opaque clothing any portion of the |
|---|
| 19 | 19 | | breasts below the top of the areola of the breasts, if the person is |
|---|
| 20 | 20 | | female, or any portion of the genitals or buttocks. |
|---|
| 21 | 21 | | (2) "Sexually oriented business" means: |
|---|
| 22 | 22 | | (A) a nightclub, bar, restaurant, or similar |
|---|
| 23 | 23 | | commercial enterprise that: |
|---|
| 24 | 24 | | [(A)] (i) provides for an audience of two or more |
|---|
| 25 | 25 | | individuals live nude entertainment or live nude performances; and |
|---|
| 26 | 26 | | [(B)] (ii) authorizes on-premises consumption of |
|---|
| 27 | 27 | | alcoholic beverages, regardless of whether the consumption of |
|---|
| 28 | 28 | | alcoholic beverages is under a license or permit issued under the |
|---|
| 29 | 29 | | Alcoholic Beverage Code; or |
|---|
| 30 | 30 | | (B) a business or commercial enterprise that engages |
|---|
| 31 | 31 | | in or hosts any activity defined as a "sexually oriented |
|---|
| 32 | 32 | | performance" under Section 43.28, Penal Code. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
