88 AN ACT
99 relating to the expiration date of certain driver's licenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 521.271(a), (a-2), and (b),
1212 Transportation Code, are amended to read as follows:
1313 (a) Each original driver's license, provisional license,
1414 learner license, or occupational driver's license issued to an
1515 applicant who is a citizen, national, or legal permanent resident
1616 of the United States or a refugee or asylee lawfully admitted into
1717 the United States expires as follows:
1818 (1) except as provided by Section 521.2711, a driver's
1919 license expires on the first birthday of the license holder
2020 occurring after the 10th [eighth] anniversary of the date of the
2121 application;
2222 (2) a provisional license expires on the 18th birthday
2323 of the license holder;
2424 (3) a learner license expires on the 18th birthday of
2525 the license holder;
2626 (4) an occupational driver's license expires on the
2727 first anniversary of the court order granting the license; and
2828 (5) unless an earlier date is otherwise provided, a
2929 driver's license issued to a person whose residence or domicile is a
3030 correctional facility or a parole facility expires on the first
3131 birthday of the license holder occurring after the first
3232 anniversary of the date of issuance.
3333 (a-2) Each original driver's license issued to an applicant
3434 who is not a citizen, national, or legal permanent resident of the
3535 United States or a refugee or asylee lawfully admitted into the
3636 United States expires on:
3737 (1) the earlier of:
3838 (A) the first birthday of the license holder
3939 occurring after the 10th [sixth] anniversary of the date of the
4040 application; or
4141 (B) the expiration date of the license holder's
4242 lawful presence in the United States as determined by the
4343 appropriate United States agency in compliance with federal law; or
4444 (2) the first anniversary of the date of issuance, if
4545 there is no definite expiration date for the applicant's authorized
4646 stay in the United States.
4747 (b) Except as provided by Section 521.2711, a driver's
4848 license that is renewed expires on the earlier of:
4949 (1) the 10th [eighth] anniversary of the expiration
5050 date before renewal if the applicant is a citizen, national, or
5151 legal permanent resident of the United States or a refugee or asylee
5252 lawfully admitted into the United States;
5353 (1-a) for an applicant not described by Subdivision
5454 (1):
5555 (A) the earlier of:
5656 (i) the 10th [eighth] anniversary of the
5757 expiration date before renewal; or
5858 (ii) the expiration date of the applicant's
5959 authorized stay in the United States; or
6060 (B) the first anniversary of the date of
6161 issuance, if there is no definite expiration date for the
6262 applicant's authorized stay in the United States; or
6363 (2) for a renewal driver's license issued to a person
6464 whose residence or domicile is a correctional facility or a parole
6565 facility, the first birthday of the license holder occurring after
6666 the first anniversary of the date of issuance unless an earlier date
6767 is otherwise provided.
6868 SECTION 2. The changes in law made by this Act apply to a
6969 driver's license issued on or after the effective date of this Act.
7070 A driver's license issued before the effective date of this Act is
7171 governed by the law in effect on the date the application was
7272 submitted, and the former law is continued in effect for that
7373 purpose.
7474 SECTION 3. This Act takes effect September 1, 2025.
