88 AN ACT
99 relating to criminal conduct involving a catalytic converter
1010 removed from a motor vehicle; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 31.21(b), Penal Code, is amended to read
1313 as follows:
1414 (b) A person is presumed to be authorized to possess a
1515 catalytic converter that has been removed from a motor vehicle if
1616 the person:
1717 (1) is the owner, as defined by Section 601.002,
1818 Transportation Code, of the vehicle from which the catalytic
1919 converter was removed or is authorized by the vehicle owner to
2020 possess the catalytic converter; or
2121 (2) possesses the catalytic converter in the ordinary
2222 course of the person's business, including in the ordinary course
2323 of business of an entity described by Section 1956.123(1),
2424 Occupations Code.
2525 SECTION 2. Chapter 1956, Occupations Code, is amended by
2626 adding Subchapter C-2 to read as follows:
2727 SUBCHAPTER C-2. RESTRICTION ON SALE OF CATALYTIC CONVERTER REMOVED
2828 FROM MOTOR VEHICLE TO CERTAIN PERSONS
2929 Sec. 1956.130. DEFINITION. In this subchapter, "motor
3030 vehicle" has the meaning assigned by Section 541.201,
3131 Transportation Code.
3232 Sec. 1956.131. APPLICABILITY. Notwithstanding any other
3333 provision of this chapter, this subchapter applies to the sale by
3434 any person, including a person described by Section 1956.002(1), of
3535 a catalytic converter removed from a motor vehicle to any other
3636 person.
3737 Sec. 1956.132. OFFENSE: SALE OF CATALYTIC CONVERTER REMOVED
3838 FROM MOTOR VEHICLE TO PERSON OTHER THAN METAL RECYCLING ENTITY. (a)
3939 A person commits an offense if the person sells a catalytic
4040 converter removed from a motor vehicle to a person who is not a
4141 metal recycling entity registered under this chapter.
4242 (b) An offense under this section is a state jail felony.
4343 (c) If conduct constituting an offense under this section
4444 also constitutes an offense under another law, the actor may be
4545 prosecuted under this section, the other law, or both.
4646 SECTION 3. This Act takes effect September 1, 2025.
