9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 24, Property Code, is amended by adding Section |
---|
11 | 11 | | 24.00l(c) to read as follows: |
---|
12 | 12 | | Sec. 24.00l(c) - In a case claiming forcible entry and |
---|
13 | 13 | | detainer, the Justice Court shall set a hearing no later than ten |
---|
14 | 14 | | days after the date the petition is filed and no sooner than three |
---|
15 | 15 | | days after the citation is served. If a Justice Court fails to |
---|
16 | 16 | | timely set a hearing in accordance with this Section 24.0ll(d), the |
---|
17 | 17 | | Justice of the Peace of such Justice Court shall be subject to |
---|
18 | 18 | | mandamus. |
---|
19 | 19 | | SECTION 2: Chapter 24, Property Code, is amended by adding |
---|
20 | 20 | | Section 24.0071 to read as follows: |
---|
21 | 21 | | Sec. 24.0071 - A county court shall schedule the trial date |
---|
22 | 22 | | on an appeal from a Justice Court pursuant to Section 24.001 of |
---|
23 | 23 | | Chapter 24 of the Texas Property Code no later than 21 days after |
---|
24 | 24 | | the appeal is filed in the Justice Court. |
---|
25 | 25 | | SECTION 3: The changes in law made by this Act apply only to |
---|
26 | 26 | | an eviction suit in which the petition is filed on or after the |
---|
27 | 27 | | effective date of this Act. An eviction suit in which the petition |
---|
28 | 28 | | is filed before the effective date of this Act is governed by the |
---|
29 | 29 | | law as it existed immediately before the effective date of this Act, |
---|
30 | 30 | | and that law is continued in effect for that purpose. |
---|
31 | 31 | | SECTION 4: This Act takes effect September 1, 2025. |
