77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the state law enforcement authority of federal National
1010 Park Service law enforcement officers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 2A.002, Code of Criminal Procedure, is
1313 amended by amending Subsection (d) and adding Subsection (d-1) to
1414 read as follows:
1515 (d) A commissioned law enforcement officer of the National
1616 Park Service is not a peace officer under the laws of this state but
1717 has:
1818 (1) the powers of arrest, search, and seizure as to any
1919 offense under the laws of this state committed in a national park or
2020 national recreation area;
2121 (2) the power to execute any arrest warrant or search
2222 warrant issued under the laws of this state; and
2323 (3) the powers granted to a peace officer by Chapters
2424 573 and 574, Health and Safety Code.
2525 (d-1) For purposes of Subsection (d) [In this subsection],
2626 "national park or national recreation area" means a national park
2727 or national recreation area included in the National Park System as
2828 defined by 54 U.S.C. Section 100102.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2025.
