| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article 2A.002, Code of Criminal Procedure, is |
|---|
| 13 | 13 | | amended by amending Subsection (d) and adding Subsection (d-1) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (d) A commissioned law enforcement officer of the National |
|---|
| 16 | 16 | | Park Service is not a peace officer under the laws of this state but |
|---|
| 17 | 17 | | has: |
|---|
| 18 | 18 | | (1) the powers of arrest, search, and seizure as to any |
|---|
| 19 | 19 | | offense under the laws of this state committed in a national park or |
|---|
| 20 | 20 | | national recreation area; |
|---|
| 21 | 21 | | (2) the power to execute any arrest warrant or search |
|---|
| 22 | 22 | | warrant issued under the laws of this state; and |
|---|
| 23 | 23 | | (3) the powers granted to a peace officer by Chapters |
|---|
| 24 | 24 | | 573 and 574, Health and Safety Code. |
|---|
| 25 | 25 | | (d-1) For purposes of Subsection (d) [In this subsection], |
|---|
| 26 | 26 | | "national park or national recreation area" means a national park |
|---|
| 27 | 27 | | or national recreation area included in the National Park System as |
|---|
| 28 | 28 | | defined by 54 U.S.C. Section 100102. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2025. |
