| 9 | 9 | | including requirements pertaining to vehicle titles. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2309.301, Occupations Code, is amended |
|---|
| 12 | 12 | | by amending the heading and Subsections (a) through (c) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | Sec. 2309.301. DUTIES [ON ACQUISITION OF SALVAGE MOTOR] |
|---|
| 15 | 15 | | CONCERNING VEHICLE TITLES. (a) A used automotive parts recycler |
|---|
| 16 | 16 | | who acquires ownership of a motor vehicle, nonrepairable motor |
|---|
| 17 | 17 | | vehicle, or salvage motor vehicle for the purpose of dismantling, |
|---|
| 18 | 18 | | scrapping, or destroying the vehicle shall at the time of |
|---|
| 19 | 19 | | acquisition obtain a properly assigned title from the previous |
|---|
| 20 | 20 | | owner of the vehicle, or other evidence of ownership acceptable to |
|---|
| 21 | 21 | | the Department of Motor Vehicles in accordance with Subchapter E, |
|---|
| 22 | 22 | | Chapter 501, Transportation Code. |
|---|
| 23 | 23 | | (b) The [A] used automotive parts recycler [who acquires |
|---|
| 24 | 24 | | ownership of a motor vehicle, nonrepairable motor vehicle, or |
|---|
| 25 | 25 | | salvage motor vehicle for the purpose of dismantling, scrapping, or |
|---|
| 26 | 26 | | destroying the motor vehicle,] shall, before the 31st day after the |
|---|
| 27 | 27 | | date of acquiring the motor vehicle, submit to the Texas Department |
|---|
| 28 | 28 | | of Motor Vehicles [Transportation] the [a properly assigned |
|---|
| 29 | 29 | | manufacturer's certificate of origin, regular certificate of |
|---|
| 30 | 30 | | title, nonrepairable vehicle title, salvage vehicle title, other] |
|---|
| 31 | 31 | | ownership document described in Subsection (a) [, or comparable |
|---|
| 32 | 32 | | out-of-state ownership document for the motor vehicle]. |

| 33 | 33 | | (c) After receiving the [title or] ownership document, the |
|---|
| 34 | 34 | | Texas Department of Motor Vehicles [Transportation] shall issue the |
|---|
| 35 | 35 | | used automotive parts recycler a receipt for the [manufacturer's |
|---|
| 36 | 36 | | certificate of origin, regular certificate of title, nonrepairable |
|---|
| 37 | 37 | | vehicle title, salvage vehicle title, other ownership document, or |
|---|
| 38 | 38 | | comparable out-of-state] ownership document. The used automotive |
|---|
| 39 | 39 | | parts recycler shall maintain a copy of the receipt for a period of |
|---|
| 40 | 40 | | three years from the date of issuance. |

| 41 | 41 | | SECTION 2. Sections 2309.301(d) and 2309.357, Occupations |
|---|
| 42 | 42 | | Code, are repealed. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2025. |
