149 relating to a prescription drug purchasing pool for certain health
1510 benefit plan issuers and employers.
1611 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1712 SECTION 1. Subtitle A, Title 6, Health and Safety Code, is
1813 amended by adding Chapter 446 to read as follows:
1914 CHAPTER 446. PRESCRIPTION DRUG PURCHASING POOL
2015 Sec. 446.001. DEFINITIONS. In this chapter:
21- (1) "Commission" means the Health and Human Services
22- Commission.
23- (2) "Health benefit plan issuer" means an insurer,

2417 health maintenance organization, or other entity authorized to
2518 provide health benefits coverage under the laws of this state.

3831 Sec. 446.002. PRESCRIPTION DRUG PURCHASING POOL. (a) The

6558 (4) the method by which a participant contributes
6659 money to the pool; and
6760 (5) the method for disenrolling a participant from the
6861 pool or terminating a participant's eligibility to participate in
6962 the pool.
70- Sec. 446.004. OPTIONAL STOP LOSS COVERAGE. The commission

7972 under this section does not constitute a multiple employer welfare
8073 arrangement, as defined by Section 846.001, Insurance Code.

82- adopt rules as necessary to implement this chapter.

8376 SECTION 2. As soon as practicable after the effective date
84- of this Act, the Health and Human Services Commission shall
85- establish the prescription drug purchasing pool as required by

87- SECTION 3. The Health and Human Services Commission is
88- required to implement a provision of this Act only if the
89- legislature appropriates money specifically for that purpose. If
90- the legislature does not appropriate money specifically for that
91- purpose, the commission may, but is not required to, implement a
92- provision of this Act using other money available for that purpose.
93- SECTION 4. This Act takes effect September 1, 2025.
