9 | 9 | | relating to the receipt of financial benefits by the superintendent |

10 | 10 | | of a school district for certain services performed by the |
---|
11 | 11 | | superintendent. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 11.201, Education Code, is amended by |
---|
14 | 14 | | amending Subsection (e) and adding Subsections (f) and (g) to read |
---|
15 | 15 | | as follows: |
---|
16 | 16 | | (e) The superintendent of a school district may not receive |
---|
17 | 17 | | any financial benefit for personal services performed by the |
---|
18 | 18 | | superintendent for: |
---|
19 | 19 | | (1) any business entity that conducts or solicits |
---|
20 | 20 | | business with the district; |
---|
21 | 21 | | (2) an education business that provides services |
---|
22 | 22 | | regarding the curriculum or administration of any school district; |
---|
23 | 23 | | or |
---|
24 | 24 | | (3) another school district. |
---|
25 | 25 | | (f) Any financial benefit received by the superintendent |
---|
26 | 26 | | for performing personal services for any [other] entity not |
---|
27 | 27 | | described by Subsection (e), including an [a school district,] |
---|
28 | 28 | | open-enrollment charter school, regional education service center, |
---|
29 | 29 | | or public or private institution of higher education, must be |
---|
30 | 30 | | approved by the board of trustees on a case-by-case basis in an open |
---|
31 | 31 | | meeting. |
---|
32 | 32 | | (g) For purposes of Subsections (e) and (f) [this |
---|
33 | 33 | | subsection], the receipt of reimbursement for a reasonable expense |
---|
34 | 34 | | is not considered a financial benefit. |
---|
35 | 35 | | SECTION 2. Section 11.201, Education Code, as amended by |
---|
36 | 36 | | this Act, applies only to a financial benefit received by the |
---|
37 | 37 | | superintendent of a school district on or after the effective date |
---|
38 | 38 | | of this Act. |
---|
39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2025. |
