77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the applicability of the Texas Electrical Safety and
1010 Licensing Act to, and the regulation by certain political
1111 subdivisions of, the installation of roofing materials containing
1212 integrated photovoltaic technology.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 1305.003(a), Occupations Code, is
1515 amended to read as follows:
1616 (a) This chapter does not apply to:
1717 (1) the installation of electrical equipment in a
1818 ship, watercraft other than a floating building, railway rolling
1919 stock, aircraft, motor vehicle, or recreational vehicle;
2020 (2) the installation of electrical equipment
2121 underground in a mine and in self-propelled mobile surface mining
2222 machinery and its attendant electrical trailing cable;
2323 (3) the installation of electrical equipment for
2424 generation, transformation, transmission, or distribution of power
2525 used exclusively to operate railway rolling stock or exclusively
2626 for signaling and communications purposes;
2727 (4) the installation, maintenance, alteration, or
2828 repair of communications equipment provided by a
2929 telecommunications provider;
3030 (5) the installation, maintenance, alteration, or
3131 repair of electrical equipment under the exclusive control of an
3232 electric utility, power generation company as defined by Sections
3333 31.002(1) and (10), Utilities Code, electric cooperative, or
3434 municipally owned utility and used for communications or metering,
3535 or for the generation, control, transformation, transmission, and
3636 distribution of electrical energy, and located:
3737 (A) in a building used exclusively by a utility
3838 or power generation company for those purposes;
3939 (B) outdoors on property owned or leased by the
4040 utility or power generation company;
4141 (C) on public highways, streets, roads, or other
4242 public rights-of-way; or
4343 (D) outdoors by established rights in vaults or
4444 on private property;
4545 (6) work not specifically regulated by a municipal
4646 ordinance that is performed in or on a dwelling by a person who owns
4747 and resides in the dwelling;
4848 (7) work involved in the manufacture of electrical
4949 equipment that includes the on-site and off-site manufacturing,
5050 commissioning, testing, calibrating, coordinating,
5151 troubleshooting, or evaluating of electrical equipment, the
5252 repairing or retrofitting of electrical equipment with components
5353 of the same ampacity, and the maintenance and servicing of
5454 electrical equipment within the equipment's enclosure that is
5555 performed by an authorized employee or authorized representative of
5656 an electrical equipment manufacturer and limited to the type of
5757 products manufactured by the manufacturer;
5858 (8) electrical work if:
5959 (A) the work is performed by a person who does not
6060 engage in electrical work for the public;
6161 (B) the work is performed by a person regularly
6262 employed as a maintenance person or maintenance electrician for a
6363 business; and
6464 (C) the electrical work does not involve the
6565 installation of electrical equipment during new construction as
6666 defined by rules adopted under Chapter 151, Tax Code;
6767 (9) the installation, maintenance, alteration, or
6868 repair of electrical equipment or associated wiring under the
6969 exclusive control of a gas utility and used for communications or
7070 metering or for the control, transmission, or distribution of
7171 natural gas;
7272 (10) thoroughfare lighting, traffic signals,
7373 intelligent transportation systems, and telecommunications
7474 controlled by a governmental entity;
7575 (11) electrical connections supplying heating,
7676 ventilation, and cooling and refrigeration equipment, including
7777 any required disconnect exclusively for the equipment, if the
7878 service is performed by a licensed air conditioning and
7979 refrigeration contractor under Chapter 1302;
8080 (12) the design, installation, erection, repair, or
8181 alteration of Class 1, Class 2, or Class 3 remote control,
8282 signaling, or power-limited circuits, fire alarm circuits, optical
8383 fiber cables, or communications circuits, including raceways, as
8484 defined by the National Electrical Code;
8585 (13) landscape irrigation installers, as necessary to
8686 perform the installation and maintenance of irrigation control
8787 systems, and landscapers, as necessary to perform the installation
8888 and maintenance of low-voltage exterior lighting and holiday
8989 lighting excluding any required power source;
9090 (14) electrical work performed at a business that
9191 operates:
9292 (A) a chemical plant, petrochemical plant,
9393 refinery, natural gas plant, natural gas treating plant, pipeline,
9494 or oil and gas exploration and production operation by a person who
9595 works solely for and is employed by that business; or
9696 (B) a chemical plant, petrochemical plant,
9797 refinery, natural gas plant, or natural gas treatment plant by a
9898 person who under a contract of at least 12 months' duration performs
9999 electrical work for that plant and:
100100 (i) the electrical work is not performed
101101 during new construction as defined by rules adopted under Chapter
102102 151, Tax Code; or
103103 (ii) the person is not working for a
104104 contractor that has a principal place of business in another state
105105 or territory of the United States or a foreign country;
106106 (15) the installation, maintenance, alteration, or
107107 repair of elevators, escalators, or related equipment, excluding
108108 any required power source, regulated under Chapter 754, Health and
109109 Safety Code;
110110 (16) the installation, maintenance, alteration, or
111111 repair of equipment or network facilities provided or utilized by a
112112 cable operator, as that term is defined by 47 U.S.C. Section 522, as
113113 amended;
114114 (17) the location, design, construction, extension,
115115 maintenance, and installation of on-site sewage disposal systems in
116116 accordance with Chapter 366, Health and Safety Code, or an on-site
117117 sewage facility installer licensed under Chapter 37, Water Code;
118118 (18) electrical work performed on a building,
119119 structure, or equipment in agricultural use as defined by Section
120120 11.002, Water Code, other than the processing of an agricultural
121121 commodity;
122122 (19) the installation, maintenance, alteration, or
123123 repair of well pumps and equipment in accordance with Chapter 1902;
124124 (20) electrical work required for the construction and
125125 assembly of HUD-code manufactured housing or modular housing and
126126 building units, other than the installation of service entrance
127127 conductors, that is performed by a licensed manufacturer or
128128 installer under Chapter 1201 or 1202, as applicable, if work
129129 performed is within the scope of the license as defined by
130130 applicable statutes and administrative rules;
131131 (21) work performed by a plumber who holds a license or
132132 endorsement or is registered under Chapter 1301 that is necessary
133133 to install, service, maintain, repair, or replace any type of
134134 plumbing fixture or appliance, as described by Section 1301.002(7),
135135 including a water heater, food disposer, garbage disposal, water
136136 softener, dishwashing machine, and clothes washing machine on
137137 existing electrical circuits only;
138138 (22) the maintenance or repair of a residential
139139 appliance by a residential appliance dealer or manufacturer or a
140140 person authorized by a residential appliance dealer or manufacturer
141141 using only components of the same type and ampacity as the original
142142 components; [and]
143143 (23) the maintenance, alteration, or repair of a
144144 pool-related electrical device by, or pool-related electrical
145145 maintenance performed by, an employee of a municipality on a pool
146146 owned or operated by the municipality; and
147147 (24) a roofing contractor who installs on a building a
148148 roofing material containing integrated photovoltaic technology if
149149 the contractor does not connect the material to the electrical
150150 wiring system of the building.
151151 SECTION 2. Section 1305.201, Occupations Code, is amended
152152 by adding Subsection (g) to read as follows:
153153 (g) A municipality or region may not adopt or enforce an
154154 ordinance or other regulation applicable to electrical work that
155155 prohibits the installation on a building of a roofing material
156156 containing integrated photovoltaic technology by a roofing
157157 contractor if the contractor does not connect the material to the
158158 electrical wiring system of the building.
159159 SECTION 3. This Act takes effect September 1, 2025.
