8	8	AN ACT
9	9	relating to the applicability of the Texas Electrical Safety and
10	10	Licensing Act to, and the regulation by certain political
11	11	subdivisions of, the installation of roofing materials containing
12	12	integrated photovoltaic technology.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 1305.003(a), Occupations Code, is
15	15	amended to read as follows:
16	16	(a) This chapter does not apply to:
17	17	(1) the installation of electrical equipment in a
18	18	ship, watercraft other than a floating building, railway rolling
19	19	stock, aircraft, motor vehicle, or recreational vehicle;
20	20	(2) the installation of electrical equipment
21	21	underground in a mine and in self-propelled mobile surface mining
22	22	machinery and its attendant electrical trailing cable;
23	23	(3) the installation of electrical equipment for
24	24	generation, transformation, transmission, or distribution of power
25	25	used exclusively to operate railway rolling stock or exclusively
26	26	for signaling and communications purposes;
27	27	(4) the installation, maintenance, alteration, or
28	28	repair of communications equipment provided by a
29	29	telecommunications provider;
30	30	(5) the installation, maintenance, alteration, or
31	31	repair of electrical equipment under the exclusive control of an
32	32	electric utility, power generation company as defined by Sections
33	33	31.002(1) and (10), Utilities Code, electric cooperative, or
34	34	municipally owned utility and used for communications or metering,
35	35	or for the generation, control, transformation, transmission, and
36	36	distribution of electrical energy, and located:
37	37	(A) in a building used exclusively by a utility
38	38	or power generation company for those purposes;
39	39	(B) outdoors on property owned or leased by the
40	40	utility or power generation company;
41	41	(C) on public highways, streets, roads, or other
42	42	public rights-of-way; or
43	43	(D) outdoors by established rights in vaults or
44	44	on private property;
45	45	(6) work not specifically regulated by a municipal
46	46	ordinance that is performed in or on a dwelling by a person who owns
47	47	and resides in the dwelling;
48	48	(7) work involved in the manufacture of electrical
49	49	equipment that includes the on-site and off-site manufacturing,
50	50	commissioning, testing, calibrating, coordinating,
51	51	troubleshooting, or evaluating of electrical equipment, the
52	52	repairing or retrofitting of electrical equipment with components
53	53	of the same ampacity, and the maintenance and servicing of
54	54	electrical equipment within the equipment's enclosure that is
55	55	performed by an authorized employee or authorized representative of
56	56	an electrical equipment manufacturer and limited to the type of
57	57	products manufactured by the manufacturer;
58	58	(8) electrical work if:
59	59	(A) the work is performed by a person who does not
60	60	engage in electrical work for the public;
61	61	(B) the work is performed by a person regularly
62	62	employed as a maintenance person or maintenance electrician for a
63	63	business; and
64	64	(C) the electrical work does not involve the
65	65	installation of electrical equipment during new construction as
66	66	defined by rules adopted under Chapter 151, Tax Code;
67	67	(9) the installation, maintenance, alteration, or
68	68	repair of electrical equipment or associated wiring under the
69	69	exclusive control of a gas utility and used for communications or
70	70	metering or for the control, transmission, or distribution of
71	71	natural gas;
72	72	(10) thoroughfare lighting, traffic signals,
73	73	intelligent transportation systems, and telecommunications
74	74	controlled by a governmental entity;
75	75	(11) electrical connections supplying heating,
76	76	ventilation, and cooling and refrigeration equipment, including
77	77	any required disconnect exclusively for the equipment, if the
78	78	service is performed by a licensed air conditioning and
79	79	refrigeration contractor under Chapter 1302;
80	80	(12) the design, installation, erection, repair, or
81	81	alteration of Class 1, Class 2, or Class 3 remote control,
82	82	signaling, or power-limited circuits, fire alarm circuits, optical
83	83	fiber cables, or communications circuits, including raceways, as
84	84	defined by the National Electrical Code;
85	85	(13) landscape irrigation installers, as necessary to
86	86	perform the installation and maintenance of irrigation control
87	87	systems, and landscapers, as necessary to perform the installation
88	88	and maintenance of low-voltage exterior lighting and holiday
89	89	lighting excluding any required power source;
90	90	(14) electrical work performed at a business that
91	91	operates:
92	92	(A) a chemical plant, petrochemical plant,
93	93	refinery, natural gas plant, natural gas treating plant, pipeline,
94	94	or oil and gas exploration and production operation by a person who
95	95	works solely for and is employed by that business; or
96	96	(B) a chemical plant, petrochemical plant,
97	97	refinery, natural gas plant, or natural gas treatment plant by a
98	98	person who under a contract of at least 12 months' duration performs
99	99	electrical work for that plant and:
100	100	(i) the electrical work is not performed
101	101	during new construction as defined by rules adopted under Chapter
102	102	151, Tax Code; or
103	103	(ii) the person is not working for a
104	104	contractor that has a principal place of business in another state
105	105	or territory of the United States or a foreign country;
106	106	(15) the installation, maintenance, alteration, or
107	107	repair of elevators, escalators, or related equipment, excluding
108	108	any required power source, regulated under Chapter 754, Health and
109	109	Safety Code;
110	110	(16) the installation, maintenance, alteration, or
111	111	repair of equipment or network facilities provided or utilized by a
112	112	cable operator, as that term is defined by 47 U.S.C. Section 522, as
113	113	amended;
114	114	(17) the location, design, construction, extension,
115	115	maintenance, and installation of on-site sewage disposal systems in
116	116	accordance with Chapter 366, Health and Safety Code, or an on-site
117	117	sewage facility installer licensed under Chapter 37, Water Code;
118	118	(18) electrical work performed on a building,
119	119	structure, or equipment in agricultural use as defined by Section
120	120	11.002, Water Code, other than the processing of an agricultural
121	121	commodity;
122	122	(19) the installation, maintenance, alteration, or
123	123	repair of well pumps and equipment in accordance with Chapter 1902;
124	124	(20) electrical work required for the construction and
125	125	assembly of HUD-code manufactured housing or modular housing and
126	126	building units, other than the installation of service entrance
127	127	conductors, that is performed by a licensed manufacturer or
128	128	installer under Chapter 1201 or 1202, as applicable, if work
129	129	performed is within the scope of the license as defined by
130	130	applicable statutes and administrative rules;
131	131	(21) work performed by a plumber who holds a license or
132	132	endorsement or is registered under Chapter 1301 that is necessary
133	133	to install, service, maintain, repair, or replace any type of
134	134	plumbing fixture or appliance, as described by Section 1301.002(7),
135	135	including a water heater, food disposer, garbage disposal, water
136	136	softener, dishwashing machine, and clothes washing machine on
137	137	existing electrical circuits only;
138	138	(22) the maintenance or repair of a residential
139	139	appliance by a residential appliance dealer or manufacturer or a
140	140	person authorized by a residential appliance dealer or manufacturer
141	141	using only components of the same type and ampacity as the original
142	142	components; [and]
143	143	(23) the maintenance, alteration, or repair of a
144	144	pool-related electrical device by, or pool-related electrical
145	145	maintenance performed by, an employee of a municipality on a pool
146	146	owned or operated by the municipality; and
147	147	(24) a roofing contractor who installs on a building a
148	148	roofing material containing integrated photovoltaic technology if
149	149	the contractor does not connect the material to the electrical
150	150	wiring system of the building.
151	151	SECTION 2. Section 1305.201, Occupations Code, is amended
152	152	by adding Subsection (g) to read as follows:
153	153	(g) A municipality or region may not adopt or enforce an
154	154	ordinance or other regulation applicable to electrical work that
155	155	prohibits the installation on a building of a roofing material
156	156	containing integrated photovoltaic technology by a roofing
157	157	contractor if the contractor does not connect the material to the
158	158	electrical wiring system of the building.
159	159	SECTION 3. This Act takes effect September 1, 2025.
