77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to granting limited state law enforcement authority to
1010 certain federal special agents.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 2A.002(a), Code of Criminal Procedure,
1313 is amended to read as follows:
1414 (a) The following criminal investigators of the United
1515 States are not peace officers but have the powers of arrest, search,
1616 and seizure under the laws of this state as to felony offenses only:
1717 (1) a special agent of the Federal Bureau of
1818 Investigation;
1919 (2) a special agent of the Secret Service;
2020 (3) a special agent of United States Immigration and
2121 Customs Enforcement;
2222 (4) a special agent of the Bureau of Alcohol, Tobacco,
2323 Firearms and Explosives;
2424 (5) a special agent of the United States Drug
2525 Enforcement Administration;
2626 (6) an inspector of the United States Postal
2727 Inspection Service;
2828 (7) a special agent of the Criminal Investigation
2929 Division of the Internal Revenue Service;
3030 (8) a civilian special agent of the United States
3131 Naval Criminal Investigative Service;
3232 (9) a marshal or deputy marshal of the United States
3333 Marshals Service;
3434 (10) a special agent of the United States Department
3535 of State, Bureau of Diplomatic Security;
3636 (11) a special agent of the Treasury Inspector General
3737 for Tax Administration;
3838 (12) a special agent of the Office of Inspector
3939 General of the United States Social Security Administration;
4040 (13) a special agent of the Office of Inspector
4141 General of the United States Department of Veterans Affairs;
4242 (14) a special agent of the Office of Inspector
4343 General of the United States Department of Agriculture;
4444 (15) a special agent of the Office of Export
4545 Enforcement of the United States Department of Commerce;
4646 (16) a special agent of the Criminal Investigation
4747 Command of the United States Army;
4848 (17) a special agent of the Office of Special
4949 Investigations of the United States Air Force; [and]
5050 (18) a police officer with the Office of Security and
5151 Law Enforcement of the United States Department of Veterans
5252 Affairs;
5353 (19) a special agent of the Office of Inspector
5454 General of the United States Department of Housing and Urban
5555 Development; and
5656 (20) a special agent of the Office of Inspector
5757 General of the Federal Housing Finance Agency.
5858 SECTION 2. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2025.
