| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subtitle B, Title 4, Health and Safety Code, is |
|---|
| 13 | 13 | | amended by adding Chapter 250A to read as follows: |
|---|
| 14 | 14 | | CHAPTER 250A. EMPLOYMENT VERIFICATION OF HEALTH FACILITY |
|---|
| 15 | 15 | | APPLICANTS |
|---|
| 16 | 16 | | Sec. 250A.001. DEFINITIONS. In this chapter: |
|---|
| 17 | 17 | | (1) "Commission" means the Health and Human Services |
|---|
| 18 | 18 | | Commission. |
|---|
| 19 | 19 | | (2) "Executive commissioner" means the executive |
|---|
| 20 | 20 | | commissioner of the commission. |
|---|
| 21 | 21 | | (3) "Health facility" means a health facility licensed |
|---|
| 22 | 22 | | by the commission. |
|---|
| 23 | 23 | | Sec. 250A.002. REQUIRED EMPLOYMENT VERIFICATION. (a) Each |
|---|
| 24 | 24 | | health facility shall conduct an employment verification for each |
|---|
| 25 | 25 | | applicant the facility may potentially employ at the facility |
|---|
| 26 | 26 | | before offering the applicant the position. In conducting the |
|---|
| 27 | 27 | | employment verification, the facility shall at a minimum contact |
|---|
| 28 | 28 | | the previous employers listed in the submitted application |
|---|
| 29 | 29 | | materials for each applicant the facility may potentially employ |
|---|
| 30 | 30 | | in a position in which the applicant: |
|---|
| 31 | 31 | | (1) provides services to children or vulnerable |
|---|
| 32 | 32 | | adults; or |
|---|
| 33 | 33 | | (2) handles any state money. |
|---|
| 34 | 34 | | (b) A health facility may contract with an appropriately |
|---|
| 35 | 35 | | qualified person to conduct an employment verification required by |
|---|
| 36 | 36 | | this section. |
|---|
| 37 | 37 | | Sec. 250A.003. RULES. The executive commissioner may adopt |
|---|
| 38 | 38 | | rules necessary to implement this chapter. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2025. |
