88 AN ACT
99 relating to employment verification of certain health facility
1010 applicants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 4, Health and Safety Code, is
1313 amended by adding Chapter 250A to read as follows:
1414 CHAPTER 250A. EMPLOYMENT VERIFICATION OF HEALTH FACILITY
1515 APPLICANTS
1616 Sec. 250A.001. DEFINITIONS. In this chapter:
1717 (1) "Commission" means the Health and Human Services
1818 Commission.
1919 (2) "Executive commissioner" means the executive
2020 commissioner of the commission.
2121 (3) "Health facility" means a health facility licensed
2222 by the commission.
2323 Sec. 250A.002. REQUIRED EMPLOYMENT VERIFICATION. (a) Each
2424 health facility shall conduct an employment verification for each
2525 applicant the facility may potentially employ at the facility
2626 before offering the applicant the position. In conducting the
2727 employment verification, the facility shall at a minimum contact
2828 the previous employers listed in the submitted application
2929 materials for each applicant the facility may potentially employ
3030 in a position in which the applicant:
3131 (1) provides services to children or vulnerable
3232 adults; or
3333 (2) handles any state money.
3434 (b) A health facility may contract with an appropriately
3535 qualified person to conduct an employment verification required by
3636 this section.
3737 Sec. 250A.003. RULES. The executive commissioner may adopt
3838 rules necessary to implement this chapter.
3939 SECTION 2. This Act takes effect September 1, 2025.
