| 8 | 8 | | relating to updating the Labor Code in accordance with the United |
|---|
| 9 | 9 | | States and Texas Constitutions. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 21.125(a), Labor Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) Except as otherwise provided by this chapter, an |
|---|
| 14 | 14 | | unlawful employment practice is established when the complainant |
|---|
| 15 | 15 | | demonstrates that race, color, sex, national origin, religion, age, |
|---|
| 16 | 16 | | or disability was a motivating factor for an employment practice, |
|---|
| 17 | 17 | | even if other factors also motivated the practice, unless race, |
|---|
| 18 | 18 | | color, sex, national origin, religion,age, or disability is |
|---|
| 19 | 19 | | combined with objective job related factors to attain diversity in |
|---|
| 20 | 20 | | the employer's work force. |
|---|
| 21 | 21 | | SECTION 2. Section 21.452, Labor Code, is amended to read as |
|---|
| 22 | 22 | | follows: |
|---|
| 23 | 23 | | DEVELOPMENT AND IMPLEMENTATION OF PERSONNEL POLICIES AND |
|---|
| 24 | 24 | | PROCEDURES. Each state agency shall develop and implement |
|---|
| 25 | 25 | | personnel policies and procedures that comply with this chapter, |
|---|
| 26 | 26 | | including personnel selection procedures that incorporate a |
|---|
| 27 | 27 | | workforce diversity program. |
|---|
| 28 | 28 | | SECTION 3. The following provisions of the Labor Code are |
|---|
| 29 | 29 | | repealed: |
|---|
| 30 | 30 | | (1) Section 21.121; and |
|---|
| 31 | 31 | | (2) Subchapter J, Chapter 21. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the necessary vote, this Act takes effect |
|---|
| 36 | 36 | | January 1, 2025. |
