88 AN ACT
99 relating to the temporary sales and use tax exemptions for certain
1010 tangible personal property related to data centers and large data
1111 center projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 151.359(d), Tax Code, is amended to read
1414 as follows:
1515 (d) Subject to Subsection (k), a data center may be
1616 certified by the comptroller as a qualifying data center for
1717 purposes of this section if, on or after September 1, 2013:
1818 (1) a single qualifying occupant:
1919 (A) contracts with a qualifying owner or
2020 qualifying operator to lease space in which the qualifying occupant
2121 will locate a data center; or
2222 (B) occupies a space that was not previously used
2323 as a data center in which the qualifying occupant will locate a data
2424 center, in the case of a qualifying occupant who is also the
2525 qualifying operator and the qualifying owner; [and]
2626 (2) the qualifying owner, qualifying operator, or
2727 qualifying occupant, jointly or independently:
2828 (A) creates at least 20 qualifying jobs in the
2929 county in which the data center is located, not including jobs moved
3030 from one county in this state to another county in this state; and
3131 (B) makes or agrees to make a capital investment,
3232 on or after September 1, 2013, of at least $200 million in that
3333 particular data center over a five-year period beginning on the
3434 date the data center is certified by the comptroller as a qualifying
3535 data center; and
3636 (3) the data center described by Subdivision (1)
3737 includes the following energy conservation and efficiency
3838 measures:
3939 (A) use of a liquid cooling system instead of an
4040 air cooling system;
4141 (B) use of a row- or rack-based air cooling
4242 system instead of a room-based air cooling system; and
4343 (C) use of Energy Star-certified servers.
4444 SECTION 2. Section 151.3595(d), Tax Code, is amended to
4545 read as follows:
4646 (d) Subject to Subsection (j), a large data center project
4747 may be certified by the comptroller as a qualifying large data
4848 center project for purposes of this section if, on or after June 1,
4949 2015:
5050 (1) a single qualifying occupant:
5151 (A) contracts with a qualifying owner or
5252 qualifying operator to lease space in which the qualifying occupant
5353 will locate a large data center project; or
5454 (B) occupies a space that was not previously used
5555 as a data center in which the qualifying occupant will locate a
5656 large data center project, in the case of a qualifying occupant who
5757 is also the qualifying operator and the qualifying owner; [and]
5858 (2) the qualifying owner, qualifying operator, or
5959 qualifying occupant, independently or jointly:
6060 (A) creates at least 40 qualifying jobs in the
6161 county in which the large data center project is located, not
6262 including jobs moved from one county in this state to another county
6363 in this state;
6464 (B) on or after May 1, 2015, makes or agrees to
6565 make a capital investment of at least $500 million in that
6666 particular large data center project, the amount of which may not
6767 include a capital investment to replace personal property
6868 previously placed in service in that large data center project,
6969 over a five-year period beginning on the earlier of:
7070 (i) the date the large data center project
7171 submits the application described by Subsection (e); or
7272 (ii) the date the large data center project
7373 is certified by the comptroller as a qualifying large data center
7474 project; and
7575 (C) agrees to contract for at least 20 megawatts
7676 of transmission capacity for operation of the large data center
7777 project; and
7878 (3) the large data center project includes the
7979 following energy conservation and efficiency measures:
8080 (A) use of a liquid cooling system instead of an
8181 air cooling system;
8282 (B) use of a row- or rack-based air cooling
8383 system instead of a room-based air cooling system; and
8484 (C) use of Energy Star-certified servers.
8585 SECTION 3. (a) Section 151.359(d), Tax Code, as amended by
8686 this Act, applies only to the certification of a data center as a
8787 qualifying data center for purposes of Section 151.359, Tax Code,
8888 as amended by this Act, on or after September 1, 2026.
8989 (b) Section 151.3595(d), Tax Code, as amended by this Act,
9090 applies only to the certification of a large data center project as
9191 a qualifying large data center project for purposes of Section
9292 151.3595, Tax Code, as amended by this Act, on or after September 1,
9393 2026.
9494 SECTION 4. This Act takes effect September 1, 2025.
