77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study by the Texas Education Agency regarding
1010 recommended standards for school district facility maintenance and
1111 custodial services.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. DEFINITION. In this Act, "agency" means the
1414 Texas Education Agency.
1515 SECTION 2. STUDY REGARDING RECOMMENDED STANDARDS FOR
1616 MAINTENANCE AND CUSTODIAL SERVICES. (a) The agency shall conduct a
1717 study regarding recommended standards for school district
1818 maintenance of facilities and custodial services, including a
1919 standard for appropriate custodial workloads to adequately
2020 maintain a school district's facilities.
2121 (b) In conducting the study, the agency shall consider:
2222 (1) the square footage of a typical elementary,
2323 middle, and high school;
2424 (2) the square footage of administrative and district
2525 facilities other than instructional facilities in a typical school
2626 district;
2727 (3) appropriate levels of custodial service to provide
2828 for proper maintenance of school district facilities; and
2929 (4) the time required for different levels of
3030 custodial service based on different numbers of custodial employees
3131 and resources.
3232 (c) The study must identify:
3333 (1) the maintenance and custodial staff needed to
3434 adequately meet a typical school district's needs;
3535 (2) the tasks required to be completed by maintenance
3636 and custodial staff, including time estimates for completion of
3737 each task by an adequately equipped maintenance and custodial
3838 staff; and
3939 (3) any additional funding or other resources, if any,
4040 needed by school districts to meet the standards recommended by the
4141 study for school district maintenance of facilities and custodial
4242 services.
4343 SECTION 3. REPORT TO LEGISLATURE. Not later than December
4444 1, 2026, the agency shall submit a report to the legislature that
4545 includes the results of the study conducted under Section 2 of this
4646 Act and any associated recommendations.
4747 SECTION 4. EXPIRATION. This Act expires September 1, 2027.
4848 SECTION 5. EFFECTIVE DATE. This Act takes effect
4949 immediately if it receives a vote of two-thirds of all the members
5050 elected to each house, as provided by Section 39, Article III, Texas
5151 Constitution. If this Act does not receive the vote necessary for
5252 immediate effect, this Act takes effect September 1, 2025.
