66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the statewide intellectual and developmental
99 disability coordinating council.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 531, Government Code, is amended by
1212 adding Subchapter M-2 to read as follows:
1313 SUBCHAPTER M-2. STATEWIDE INTELLECTUAL AND DEVELOPMENTAL
1414 DISABILITY COORDINATING COUNCIL
1515 Sec. 531.491. DEFINITION. In this subchapter, "council"
1616 means the statewide intellectual and developmental disability
1717 coordinating council.
1818 Sec. 531.492. PURPOSE. The council is established to
1919 ensure this state develops a strategic approach for the provision
2020 of intellectual and developmental disability services in this
2121 state.
2222 Sec. 531.493. COMPOSITION OF COUNCIL. (a) The council is
2323 composed of the following members:
2424 (1) subject to Subsection (b), one or more
2525 representatives designated by each of the following entities:
2626 (A) the Department of State Health Services;
2727 (B) the Department of Family and Protective
2828 Services;
2929 (C) the Texas Workforce Commission;
3030 (D) the Texas Education Agency;
3131 (E) the Texas Center for Disability Studies at
3232 The University of Texas at Austin;
3333 (F) the Center on Disability and Development at
3434 Texas A&M University;
3535 (G) the Texas Department of Criminal Justice; and
3636 (H) the Commission on Jail Standards; and
3737 (2) the following members appointed by the executive
3838 commissioner:
3939 (A) a representative of a local intellectual and
4040 developmental disability authority as defined by Section 531.002,
4141 Health and Safety Code;
4242 (B) a representative of the Governor's Committee
4343 on People with Disabilities;
4444 (C) a representative of the Texas Council for
4545 Developmental Disabilities;
4646 (D) a representative of the Arc of Texas;
4747 (E) a representative of a managed care
4848 organization;
4949 (F) a provider of Medicaid long-term services and
5050 supports;
5151 (G) a person or family member of an individual
5252 with an intellectual or developmental disability;
5353 (H) a representative of the commission's office
5454 of the ombudsman;
5555 (I) representatives of the commission, with one
5656 representative appointed from each division of the commission with
5757 responsibility for:
5858 (i) Medicaid and the Children's Health
5959 Insurance Program services;
6060 (ii) intellectual and developmental
6161 disability behavioral health services;
6262 (iii) health and specialty care system
6363 employment;
6464 (iv) health, developmental, and
6565 independence services; and
6666 (v) access and eligibility services; and
6767 (J) any additional members as the executive
6868 commissioner determines appropriate who are recognized experts
6969 serving individuals with intellectual and developmental
7070 disabilities or who represent the interests of individuals with
7171 intellectual and developmental disabilities.
7272 (b) The executive commissioner shall determine the number
7373 of representatives that each entity may designate under Subsection
7474 (a)(1) to serve on the council.
7575 (c) The council may authorize another state agency or
7676 institution that provides specific intellectual and developmental
7777 disability services with the use of money appropriated by this
7878 state to designate a representative to the council.
7979 (d) A council member serves at the pleasure of the
8080 designating entity.
8181 Sec. 531.494. PRESIDING OFFICER. The executive
8282 commissioner shall designate a member of the council to serve as the
8383 presiding officer.
8484 Sec. 531.495. MEETINGS. The council shall meet at least
8585 once quarterly or more frequently at the call of the presiding
8686 officer.
8787 Sec. 531.496. DUTIES. The council:
8888 (1) shall develop and monitor the implementation of a
8989 five-year statewide intellectual and developmental disability
9090 strategic plan;
9191 (2) shall develop a biennial coordinated statewide
9292 intellectual and developmental disability expenditure proposal;
9393 (3) shall annually publish an updated inventory of
9494 state-funded intellectual and developmental disability programs
9595 and services that includes:
9696 (A) a description of the manner in which those
9797 programs and services further the purpose of the statewide
9898 intellectual and developmental disability strategic plan; and
9999 (B) an estimate of the number of individuals
100100 waiting for or interested in receiving those programs and services;
101101 and
102102 (4) may facilitate opportunities to increase
103103 collaboration for the effective expenditure of available federal
104104 and state funds for intellectual and developmental disability
105105 services in this state.
106106 SECTION 2. This Act takes effect immediately if it receives
107107 a vote of two-thirds of all the members elected to each house, as
108108 provided by Section 39, Article III, Texas Constitution. If this
109109 Act does not receive the vote necessary for immediate effect, this
110110 Act takes effect September 1, 2023.
