| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 562, Local Government Code, is amended |
|---|
| 12 | 12 | | by adding Subchapter C to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER C. WATER CONSERVATION |
|---|
| 14 | 14 | | Sec. 562.051. WATER CONSERVATION PROGRAMS. (a) The |
|---|
| 15 | 15 | | commissioners court of a county by order may adopt a water |
|---|
| 16 | 16 | | conservation program. Except as provided by Subsection (b), a |
|---|
| 17 | 17 | | water conservation program adopted under this section may establish |
|---|
| 18 | 18 | | for the unincorporated area of the county, including the |
|---|
| 19 | 19 | | extraterritorial jurisdiction of a municipality: |
|---|
| 20 | 20 | | (1) water use restrictions; |
|---|
| 21 | 21 | | (2) water conservation standards applicable to a |
|---|
| 22 | 22 | | development, redevelopment, or subdivision of a tract of land that |
|---|
| 23 | 23 | | begins after August 31, 2025; and |
|---|
| 24 | 24 | | (3) other strategies intended to reduce water use, |
|---|
| 25 | 25 | | water loss, or otherwise conserve water resources. |
|---|
| 26 | 26 | | (b) Water use restrictions and water conservation standards |
|---|
| 27 | 27 | | established under Subsection (a) do not apply to an agricultural |
|---|
| 28 | 28 | | operation, as defined by Section 251.002, Agriculture Code. |
|---|
| 29 | 29 | | (c) To the extent of a conflict between a county order |
|---|
| 30 | 30 | | adopted under this section and a municipal ordinance regulating the |
|---|
| 31 | 31 | | same conduct, the ordinance prevails. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2025. |
