77 AN ACT
88 relating to the adoption of a water conservation program by a
99 county.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 562, Local Government Code, is amended
1212 by adding Subchapter C to read as follows:
1313 SUBCHAPTER C. WATER CONSERVATION
1414 Sec. 562.051. WATER CONSERVATION PROGRAMS. (a) The
1515 commissioners court of a county by order may adopt a water
1616 conservation program. Except as provided by Subsection (b), a
1717 water conservation program adopted under this section may establish
1818 for the unincorporated area of the county, including the
1919 extraterritorial jurisdiction of a municipality:
2020 (1) water use restrictions;
2121 (2) water conservation standards applicable to a
2222 development, redevelopment, or subdivision of a tract of land that
2323 begins after August 31, 2025; and
2424 (3) other strategies intended to reduce water use,
2525 water loss, or otherwise conserve water resources.
2626 (b) Water use restrictions and water conservation standards
2727 established under Subsection (a) do not apply to an agricultural
2828 operation, as defined by Section 251.002, Agriculture Code.
2929 (c) To the extent of a conflict between a county order
3030 adopted under this section and a municipal ordinance regulating the
3131 same conduct, the ordinance prevails.
3232 SECTION 2. This Act takes effect September 1, 2025.
