8 | 8 | | relating to the provision of certain nursing services under the |
---|
9 | 9 | | case management for children and pregnant women program. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. (a) This section takes effect only if the Act of |
---|
12 | 12 | | the 89th Legislature, Regular Session, 2025, relating to |
---|
13 | 13 | | nonsubstantive additions to and corrections in enacted codes does |
---|
14 | 14 | | not become law. |
---|
15 | 15 | | (b) Subchapter K, Chapter 532, Government Code, is amended |
---|
16 | 16 | | by adding Section 532.0507 to read as follows: |
---|
17 | 17 | | Sec. 532.0507. COMPREHENSIVE NEEDS ASSESSMENT BY ADVANCED |
---|
18 | 18 | | PRACTICE NURSE OR REGISTERED NURSE. Notwithstanding the screening |
---|
19 | 19 | | results under Section 532.0505, an advanced practice nurse or |
---|
20 | 20 | | registered nurse who provides case management program services may |
---|
21 | 21 | | perform a comprehensive needs assessment, including a family needs |
---|
22 | 22 | | assessment as defined in Subchapter B, Chapter 27, Administrative |
---|
23 | 23 | | Code, for recipients considered to have a high-risk pregnancy, if |
---|
24 | 24 | | the assessment is: |
---|
25 | 25 | | (1) within the nurse's scope of practice; and |
---|
26 | 26 | | (2) incidental to the provision of nonmedical services |
---|
27 | 27 | | provided under the program. |
---|
28 | 28 | | SECTION 2. (a) This section takes effect only if the Act of |
---|
29 | 29 | | the 89th Legislature, Regular Session, 2025, relating to |
---|
30 | 30 | | nonsubstantive additions to and corrections in enacted codes does |
---|
31 | 31 | | not become law. |

32 | 32 | | (b) Subchapter Q, Chapter 531, Government Code, is amended |
---|
33 | 33 | | by adding Section 531.657 to read as follows: |
---|
34 | 34 | | Sec. 531.657. COMPREHENSIVE NEEDS ASSESSMENT BY ADVANCED |
---|
35 | 35 | | PRACTICE NURSE OR REGISTERED NURSE FOR CERTAIN PREGNANT WOMEN. |
---|
36 | 36 | | Notwithstanding the screening results under Section 531.655, an |
---|
37 | 37 | | advanced practice nurse or registered nurse who provides program |
---|
38 | 38 | | services may perform a comprehensive needs assessment, including a |
---|
39 | 39 | | family needs assessment as defined in Subchapter B, Chapter 27, |
---|
40 | 40 | | Administrative Code, for recipients considered to have a high-risk |
---|
41 | 41 | | pregnancy, if the assessment is: |
---|
42 | 42 | | (1) within the nurse's scope of practice; and |
---|
43 | 43 | | (2) incidental to the provision of nonmedical services |
---|
44 | 44 | | provided under the program. |
---|
45 | 45 | | SECTION 3. It is the intent of the 89th Legislature, Regular |
---|
46 | 46 | | Session, 2025, that the amendments made by this Act to Subchapter Q, |
---|
47 | 47 | | Chapter 531, Government Code, be harmonized with another Act of the |
---|
48 | 48 | | 89th Legislature, Regular Session, 2025, relating to |
---|
49 | 49 | | nonsubstantive additions to and corrections in enacted codes. |
---|
50 | 50 | | SECTION 4. If before implementing any provision of this Act |
---|
51 | 51 | | a state agency determines that a waiver or authorization from a |
---|
52 | 52 | | federal agency is necessary for implementation of that provision, |
---|
53 | 53 | | the agency affected by the provision shall request the waiver or |
---|
54 | 54 | | authorization and may delay implementing that provision until the |
---|
55 | 55 | | waiver or authorization is granted. |
---|
56 | 56 | | SECTION 5. This Act takes effect September 1, 2025. |
