66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the provision of certain nursing services under the
99 case management for children and pregnant women program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) This section takes effect only if the Act of
1212 the 89th Legislature, Regular Session, 2025, relating to
1313 nonsubstantive additions to and corrections in enacted codes does
1414 not become law.
1515 (b) Subchapter K, Chapter 532, Government Code, is amended
1616 by adding Section 532.0507 to read as follows:
1717 Sec. 532.0507. COMPREHENSIVE NEEDS ASSESSMENT BY ADVANCED
1818 PRACTICE NURSE OR REGISTERED NURSE. Notwithstanding the screening
1919 results under Section 532.0505, an advanced practice nurse or
2020 registered nurse who provides case management program services may
2121 perform a comprehensive needs assessment, including a family needs
2222 assessment as defined in Subchapter B, Chapter 27, Administrative
2323 Code, for recipients considered to have a high-risk pregnancy, if
2424 the assessment is:
2525 (1) within the nurse's scope of practice; and
2626 (2) incidental to the provision of nonmedical services
2727 provided under the program.
2828 SECTION 2. (a) This section takes effect only if the Act of
2929 the 89th Legislature, Regular Session, 2025, relating to
3030 nonsubstantive additions to and corrections in enacted codes does
3131 not become law.
3232 (b) Subchapter Q, Chapter 531, Government Code, is amended
3333 by adding Section 531.657 to read as follows:
3434 Sec. 531.657. COMPREHENSIVE NEEDS ASSESSMENT BY ADVANCED
3535 PRACTICE NURSE OR REGISTERED NURSE FOR CERTAIN PREGNANT WOMEN.
3636 Notwithstanding the screening results under Section 531.655, an
3737 advanced practice nurse or registered nurse who provides program
3838 services may perform a comprehensive needs assessment, including a
3939 family needs assessment as defined in Subchapter B, Chapter 27,
4040 Administrative Code, for recipients considered to have a high-risk
4141 pregnancy, if the assessment is:
4242 (1) within the nurse's scope of practice; and
4343 (2) incidental to the provision of nonmedical services
4444 provided under the program.
4545 SECTION 3. It is the intent of the 89th Legislature, Regular
4646 Session, 2025, that the amendments made by this Act to Subchapter Q,
4747 Chapter 531, Government Code, be harmonized with another Act of the
4848 89th Legislature, Regular Session, 2025, relating to
4949 nonsubstantive additions to and corrections in enacted codes.
5050 SECTION 4. If before implementing any provision of this Act
5151 a state agency determines that a waiver or authorization from a
5252 federal agency is necessary for implementation of that provision,
5353 the agency affected by the provision shall request the waiver or
5454 authorization and may delay implementing that provision until the
5555 waiver or authorization is granted.
5656 SECTION 5. This Act takes effect September 1, 2025.
