7	10		AN ACT
8	11		relating to notice to property owners regarding certain stationary
9	12		LP-gas installations.
10	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	14		SECTION 1. The heading to Subchapter M, Chapter 113,
12	15		Natural Resources Code, is amended to read as follows:
13	16		SUBCHAPTER M. REQUIRED NOTICES [CONSUMER SAFETY NOTIFICATION]
14	17		SECTION 2. The heading to Section 113.401, Natural
15	18		Resources Code, is amended to read as follows:
16	19		Sec. 113.401. CONSUMER SAFETY NOTIFICATION [NOTICE
17	20		REQUIRED].
18	21		SECTION 3. Subchapter M, Chapter 113, Natural Resources
19	22		Code, is amended by adding Section 113.402 to read as follows:
20	23		Sec. 113.402. NOTICE FOR CERTAIN STATIONARY LP-GAS
21	24		INSTALLATIONS. (a) For a proposed installation or modification of
22	25		a stationary LP-gas installation with an aggregate water capacity
23	26		of 10,000 gallons or more, the commission shall require the
24	27		applicant to mail notice containing the information required by the
25	28		commission by registered or certified mail, return receipt
26	29		requested, or by any other form of mail that provides proof of
27	30		delivery, to all owners of real property situated within 500 feet of
28	31		the proposed container location.
29	32		(b) The applicant shall maintain a record of the proof of
30	33		delivery for a period of time as determined by the commission.
31	34		SECTION 4. The change in law made by this Act applies only
32	35		to an application for the installation or modification of a
33	36		stationary LP-gas installation that is filed with the Railroad
34	37		Commission of Texas on or after the effective date of this Act. An
35	38		application for the installation or modification of a stationary
36	39		LP-gas installation that is filed before the effective date of this
37	40		Act is governed by the law in effect on the date of filing, and that
38	41		law is continued in effect for that purpose.
39	42		SECTION 5. This Act takes effect immediately if it receives
40	43		a vote of two-thirds of all the members elected to each house, as
41	44		provided by Section 39, Article III, Texas Constitution. If this
42	45		Act does not receive the vote necessary for immediate effect, this
43	46		Act takes effect September 1, 2025.
