77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to elimination of limitations periods for suits for
1010 personal injury arising from certain offenses against a child or
1111 disabled individual.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 16.003(a), Civil Practice and Remedies
1414 Code, is amended to read as follows:
1515 (a) Except as provided by Sections 16.010, 16.0031, [and]
1616 16.0045, and 16.0046, a person must bring suit for trespass for
1717 injury to the estate or to the property of another, conversion of
1818 personal property, taking or detaining the personal property of
1919 another, personal injury, forcible entry and detainer, and forcible
2020 detainer not later than two years after the day the cause of action
2121 accrues.
2222 SECTION 2. Section 16.0045(c), Civil Practice and Remedies
2323 Code, is amended to read as follows:
2424 (c) In an action for injury resulting in death arising as a
2525 result of conduct described by Subsection [(a) or] (b), the cause of
2626 action accrues on the death of the injured person.
2727 SECTION 3. Section 16.0045(a), Civil Practice and Remedies
2828 Code, is redesignated as Section 16.0046, Civil Practice and
2929 Remedies Code, and amended to read as follows:
3030 Sec. 16.0046. NO LIMITATIONS PERIOD. [(a)] A person may
3131 [must] bring a suit for personal injury against any party alleged to
3232 have caused the injury at any time [not later than 30 years after
3333 the day the cause of action accrues] if the injury arises as a
3434 result of conduct that violates:
3535 (1) Section 22.011(a)(2), Penal Code (sexual assault
3636 of a child);
3737 (2) Section 22.021(a)(1)(B), Penal Code (aggravated
3838 sexual assault of a child);
3939 (3) Section 21.02, Penal Code (continuous sexual abuse
4040 of young child or disabled individual);
4141 (4) Section 20A.02(a)(7)(A), (B), (C), (D), or (H) or
4242 Section 20A.02(a)(8), Penal Code, involving an activity described
4343 by Section 20A.02(a)(7)(A), (B), (C), (D), or (H) or sexual conduct
4444 with a child or disabled individual trafficked in the manner
4545 described by Section 20A.02(a)(7), Penal Code (certain sexual
4646 trafficking);
4747 (5) Section 43.05(a)(2) or (3), Penal Code (compelling
4848 prostitution by a child or disabled individual); [or]
4949 (6) Section 21.11, Penal Code (indecency with a
5050 child);
5151 (7) Section 21.12, Penal Code (improper relationship
5252 between educator and student);
5353 (8) Section 33.021, Penal Code (online solicitation of
5454 a minor);
5555 (9) Section 38.17, Penal Code (failure to stop or
5656 report aggravated sexual assault of child);
5757 (10) Section 43.25, Penal Code (sexual performance by
5858 a child);
5959 (11) Section 43.26, Penal Code (possession or
6060 promotion of child pornography);
6161 (12) Section 43.261, Penal Code (electronic
6262 transmission of certain visual material depicting minor); or
6363 (13) Section 43.262, Penal Code (possession or
6464 promotion of lewd visual material depicting child).
6565 SECTION 4. (a) Except as provided by this section, the
6666 changes in law made by this Act apply to a cause of action that
6767 accrues on or after the effective date of this Act.
6868 (b) Except as provided by this section, a person may bring
6969 an action described by Section 16.0046, Civil Practice and Remedies
7070 Code, as redesignated and amended by this Act, that accrued before
7171 the effective date of this Act not later than the second anniversary
7272 of the effective date of this Act.
7373 (c) The changes in law made by this Act do not affect a
7474 judgment in litigation:
7575 (1) that became final before the effective date of
7676 this Act; and
7777 (2) for which the limitations period applicable to the
7878 cause of action before the effective date of this Act was not
7979 determinative.
8080 SECTION 5. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2025.
