11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 37.052(c), Utilities Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | (c) An electric utility is not required to amend the | |
15 | 15 | utility's certificate of public convenience and necessity to | |
16 | 16 | construct a transmission line that connects the utility's existing | |
17 | 17 | transmission facilities to a substation or metering point if: | |
18 | 18 | (1) the transmission line does not exceed: | |
19 | 19 | (A) five [three] miles in length, if the line | |
20 | 20 | connects to a load-serving substation or metering point; or | |
21 | 21 | (B) two miles in length, if the line connects to a | |
22 | 22 | generation substation or metering point; | |
23 | 23 | (2) each landowner whose property would be directly | |
24 | 24 | affected by the transmission line, as provided by commission rules, | |
25 | 25 | provides written consent for the transmission line; and | |
26 | 26 | (3) all rights-of-way necessary for construction of | |
27 | 27 | the transmission line have been purchased. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
