77 AN ACT
88 relating to a pilot program awarding grants for the provision of
99 personalized treatment protocols for veterans diagnosed with
1010 post-traumatic stress disorder.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1313 amended by adding Chapter 49 to read as follows:
1414 CHAPTER 49. VETERANS PILOT PROGRAM TO PROVIDE POST-TRAUMATIC
1515 STRESS DISORDER TREATMENT
1616 Sec. 49.001. DEFINITIONS. In this chapter:
1717 (1) "Pilot program" means the pilot program
1818 established under this chapter.
1919 (2) "Veteran" means an individual who has served in:
2020 (A) an active or reserve component of the army,
2121 navy, air force, coast guard, or marine corps of the United States;
2222 or
2323 (B) the Texas National Guard, as defined by
2424 Section 431.001, Government Code.
2525 Sec. 49.002. ESTABLISHMENT AND OPERATION OF PILOT PROGRAM.
2626 (a) The commission, using available resources and in cooperation
2727 with a nonprofit veterans organization, shall establish and operate
2828 a pilot program to award grants for the provision of personalized
2929 treatment protocols to at least 250 veterans diagnosed with
3030 post-traumatic stress disorder, including treatment-resistant
3131 post-traumatic stress disorder.
3232 (b) A personalized treatment protocol provided to a veteran
3333 under the pilot program:
3434 (1) must be:
3535 (A) administered at the veteran's home; and
3636 (B) designed to reduce neuroinflammation and
3737 replenish deficient or insufficient brain chemistry to an optimal
3838 level; and
3939 (2) may not include the provision of:
4040 (A) a narcotic drug, as defined by Section
4141 481.002;
4242 (B) a psychedelic drug; or
4343 (C) a psychotropic medication, as defined by
4444 Section 266.001, Family Code.
4545 (c) The commission may award a grant under the pilot program
4646 only in accordance with a contract between the commission and a
4747 grant recipient. The contract must include provisions under which
4848 the commission is granted sufficient control to ensure the public
4949 purpose of providing treatment to veterans is accomplished and the
5050 state receives the return benefit.
5151 (d) The commission may accept gifts, grants, and donations
5252 to operate the pilot program.
5353 Sec. 49.003. RULES. The executive commissioner shall adopt
5454 rules to implement this chapter.
5555 Sec. 49.004. REPORT. Not later than October 1, 2030, the
5656 commission shall prepare and submit to the governor, the lieutenant
5757 governor, the speaker of the house of representatives, and the
5858 appropriate standing committees of the legislature a report that
5959 includes:
6060 (1) information on the number of veterans who were
6161 provided a personalized treatment protocol under the pilot program;
6262 and
6363 (2) an evaluation of the pilot program's
6464 effectiveness.
6565 Sec. 49.005. EXPIRATION. The pilot program concludes and
6666 this chapter expires September 1, 2031.
6767 SECTION 2. As soon as practicable after the effective date
6868 of this Act:
6969 (1) the executive commissioner of the Health and Human
7070 Services Commission shall adopt the rules necessary to implement
7171 Chapter 49, Health and Safety Code, as added by this Act; and
7272 (2) the Health and Human Services Commission shall
7373 establish and begin operating the pilot program under Chapter 49,
7474 Health and Safety Code, as added by this Act.
7575 SECTION 3. This Act takes effect September 1, 2025.
